Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1) Please specify any rules/provisions that the EU institutions have introduced about trade unions regarding transparency or conflict of interests in the structure of trade unions of EU Institutions and between EU staff and members of trade unions, their candidates for elections or the members of staff representations in European Institutions, the Staff Comittee and so on.

Dear Ms Angelova,

 

We refer to your email of 20 March 2020 asking for information. Please
note that this answer is given under the Code of good administrative
behaviour and not under Regulation (EC) No 1049/2001 of the European
Parliament and of the Council of 30 May 2001 regarding public access to
European Parliament, Council and Commission documents.

 

What are the conditions for being candidate in EC Staff Committee?

Article 1 of Annex II of the Staff Regulations states the general
conditions of the election :

-          Every official of the institution shall be entitled to stand
for election.

-          Membership of the local section is such as to ensure the
representation of the three function groups provided for in Article 5 of
the Staff Regulations and also of the servants referred to in the first
paragraph of Article 7 of the Conditions of Employment of other servants
of the Union .

-          Elections to the local section is valid only if two thirds of
the officials entitled to vote take part. However, if this proportion is
not attained, the second vote shall be valid if the majority of those
entitled take part.

-          Election is by secret ballot.

 

Article 7 of CEOS provides the following :

“A servant whose contract is for more than one year or for an indefinite
period shall be entitled to vote in elections and stand for election to
the Staff Committee provided for in Article 9 of the Staff Regulations.

A servant whose contract is for less than one year shall also be entitled
to vote if he has been employed for at least six months.”

 

The conditions for election to the Local Staff Committee are laid down by
the general meeting of officials of the institution in service at the
relevant place of employment. However, the appointing authority of each
institution may decide that the conditions for election are to be
determined in accordance with the preference of the staff of the
institution as expressed in a referendum.

There are eight places of employment at the Commission entailing eight
different local sections and eight different electoral rules.

For information, you will find attached the electoral rules of the Local
Staff Committee section of Brussels.

 

Could you publish the content of Article 1 Annex 1 of Staff Regulations
regarding the officials and Article 7 of CEOS concerning other agents?
