Your confirmatory application for access to documents under 
Regulation (EC) No 1049/2001 - GESTDEM 2022/2264 

Dear Mr Radečić,  
I refer to your e-mail of 11 October 2022, registered on 20 October 2022, by which you 
submit a confirmatory application in accordance with Article 7(4) of Regulation (EC) No 
1049/2001  regarding  public  access  to  European  Parliament,  Council  and  Commission 
documents1 (hereafter ‘Regulation (EC) No 1049/2001’). 
Your  confirmatory  application  was  submitted  in  relation  to  your  initial  application  of  
19 April 2022 in which you requested, I quote: 
‘All documentation (including but not limited to all email correspondence, 
attendance  lists,  agendas,  background  papers,  transcripts,  recordings  and 
minutes/notes) relating to meetings between the entities listed below and the 
Commission  (Commissioner  Simson,  and/or  her  cabinet,  and/or  officials 
from  DG  Energy)  in  which  the  EU’s  response  to  Ukraine  invasion, 
particularly the “REPowerEU: Joint European action for more affordable, 
secure and sustainable energy” plan was discussed:

-  Entities:  Hydrogen  Europe,  Air  Liquide,  Hydrogen  Council  and 
European Biogas Association,  
-  Multilateral development banks: European Bank for Reconstruction and 
Development (EBRD) and European Investment Bank (EIB).’ 
The  initial  request  was  assigned  to  the  Directorate-General  for  Energy.  As  you  did  not 
receive an initial reply from that Directorate-General within the statutory time limits, you 
submitted a confirmatory application on 11 October 2022. 
In  the  meantime,  the  initial  reply  in  question  was  sent  to  you  on  16  December  2022 
(registered  under  reference  number  Ares(2022)8753013).  This  reply  informs  you  that, 
with  regard  to  documents  originating  from  Commissioner  Simson  and/or  her  Cabinet, 
Directorate-General  for  Energy  is  awaiting  contribution  from  the  Cabinet  and  will  be 
able to complement the initial reply only once they receive it. 
Against this background, the Secretariat-General will close your confirmatory application 
related to the lack of initial reply. 
You remain entitled to submit a new confirmatory application in accordance with Article 
7(2) of Regulation (EC) No 1049/2001, should you wish to request a review of the initial 
reply of 16 December 2022.
