Dear Mr Gaberell,
I refer to your email of 13 July 2022, in which you make a request for access to
documents under Regulation (EC) No 1049/20011 (‘Regulation 1049/2001’), registered
on 14 July 2022 under the above-mentioned reference number.
You requested:
- any documents (including emails, briefings, reports, as well as attachments) received
from (or sent to) representatives of Member States since October 2020 that concern or
make mention of the commitment in the Chemicals Strategy for Sustainability that the EU
will “lead by example, and, in line with international commitments, ensure that
hazardous chemicals banned in the European Union are not produced for export,
including by amending relevant legislation if and as needed.”
- a list of meetings held (and minutes of those meetings when available) with
representatives of Member States since October 2020 at which there was any discussion
of the commitment in the Chemicals Strategy for Sustainability that the EU will “lead by
example, and, in line with international commitments, ensure that hazardous chemicals
banned in the European Union are not produced for export, including by amending
relevant legislation if and as needed.”
- any documents (including emails, briefings, reports, as well as attachments) received
from (or sent to) other Departments and executive agencies from the European

We would like to hereby inform you that DG Trade does not hold any documents that
would correspond to the description given in your application.
As specified in Article 2(3) of Regulation 1049/2001, the right of access as defined in
that regulation applies only to existing documents in the possession of DG Trade.
Given that no such documents corresponding to the description indicated in your
application are held by DG Trade, DG Trade is not in a position to fulfil your request.
Please note that within the European Commission the Directorate-General for Trade is
not in the lead for the subject matter(s) in connection to the Chemicals Strategy for
Sustainability referred to in your request, for which mainly the Directorate-General for
Environment is the lead service.
In accordance with Article 7(2) of Regulation 1049/2001, you are entitled to make a
confirmatory application requesting the Commission to review this position.
Such a confirmatory application should be addressed within 15 working days upon receipt
of this letter to the Secretariat-General of the Commission at the following address:
