SD N 298203 – EC question to Sweden
“According to notified requirement: “Anyone who carries out an activity in accordance with
the Act shall pay an annual fee to the Health and Social Care Inspectorate for the authority’s
supervision.” Art. 6 lit (a) of Dir. 2005/36/EC requires a service provider to be exempted from
registration with or membership of a professional organization. Member States may provide
either automatic temporary registration with or pro-forma membership of such a professional
organisation, provided that such registration or membership does not delay or complicate in
any way the provision of services and does not entail any additional costs for the service
provider.
EC would like to ask Swedish authorities how the provision that anyone who carries out an
activity in the context of temporary and occasional cross-border service in line with the Act
shall pay an annual fee to the Health and Social Care Inspectorate for the authority’s
supervision complies with the Art. 6 lit (a) of Dir. 2005/36/EC.”
