Re: Confirmatory Appeal 20 year medal (GESTDEM 2018/6981)

Dear Mr. Selmayr,

Hereby I hand in a confirmatory appeal regarding DG Human Resources’ decision not to provide public access to documents related to the 20 year medal which Mrs. Roelie Post was entitled to receive in 2007.

The reason given is that it would infringe the privacy of the person concerned.

This is, of course, utter nonsense.

The privacy of Mrs. Roelie Post has been infringed ever since she published a book about her work, at the suggestion of one of your predecessors Mrs. Catherine Day, and with the agreement of Commissioner Verheugen who read the transcript before publication.

This privacy was further infringed when the European Commission removed Mrs. Post from their premises and forced her to set up an NGO to counter the adoption lobby from outside. That NGO is Against Child Trafficking, of which I am the Executive Director.

Mrs. Roelie Post has had an impeccable work performance from 1983 until 2005, when she was removed from her job. I have read her yearly Career Development Reports.

I can personally testify that her performance was more than good during her 6-year secondment to Against Child Trafficking. This despite the fact that DG Justice had become part of the adoption lobby. To run a private NGO, as civil servant, has had huge financial implications for Mrs. Post.

This also got acknowledged by DG Enlargement during the yearly reviews.

The problems started when she had to re-integrate in August 2014. Her whistle-blowing letters about her situation describe it all.

In fact, relations went really sour when Mrs. Post alerted Secretary-General Mrs. Day to EU financing of SERA (de Combret) of 4.2 million euro to review the Romanian child protection system (1) . Mrs. Day tried to cancel this contract, but did not manage. She also did not hand in a complaint with OLAF.

This would have been necessary, considering the way the contract had been allocated and the considerable conflicts of interests involved.

As a result of that complaint, a meeting was organised about ‘lessons learned’ (2), ‘Legacy of the Romanian Orphans’. I believe you were present too, as then Head of Cabinet of DG Justice.

During this meeting it was, I have been told, decided that Roelie needed to do ‘something else’.

This was, however, never said to her straight in the face.

That ‘something else’ was sitting in an office doing nothing. Being ostracized.
Roelie’s situation has been spelled out in the international media. Most recently in De Telegraaf (30 January 2019) (3).

To now declare the documents related to the 20 years medal as secret for reasons of respect for her privacy seems more like a cover-up. A cover-up of the treatment she was given since Romania stopped intercountry adoption. Which was, as we all know, the only right thing to do.

I hereby request a decision, on behalf of the College, to provide public access to the documents related to Mrs. Post’s right to the 20 year medal.

In my original request I suggested, in case of privacy considerations, to please contact Mrs. Post to see if she is ready to lift the privacy requirements. I am in no doubt that she will.
