Dear M. Betel,
Following your request for access to documents which contain information on the '
molecular
pathology testing as it relates to companion diagnostic testing (tests paired with specific
drugs) that are offered within the following countries: UK, France, Germany, Spain and
Italy', we hereby inform you about the following:
The Consumers, Health, Agriculture and Food Executive Agency (Chafea) does not possess any
documents containing the aforementioned information. Thus, as the requested documents within
the meaning of article 3 of Regulation 1094/2001 do not exist, we are not in a position to satisfy
your request.
You could probably direct your request to the European Medicines Agency (EMA) which
potentially has such documents in its possession.
Finally, we draw your attention to the means of redress available against this decision. If you
wish to appeal against this decision, in accordance with Article 7(2) of Regulation 1049/2001,
you are entitled to make a confirmatory application requesting the Agency to review this
position.
Such a confirmatory application should be addressed within 15 working days upon receipt of this
letter at the following address:
