Dear Ms Reda,
We refer to your request via the AsktheEU.org website dated 21/12/2017 in which you
make a request for access to documents, registered under the above-mentioned reference
number.
Your request reads as follows: "
On October 25, 2016, the JRC presented a draft paper
called "The economics of online news aggregation and neighbouring rights for news
publishers" to DG TRADE. I am requesting all information held by TRADE concerning
both this paper (as well as comments, analysis, position papers, memos, etc). or any
information concerning copyright or neighbouring rights for press publishers."
We regret to inform you that DG TRADE does not hold any documents that would
correspond to that description.
We are aware that according to document 2 disclosed to you in reply to your request
GestDem 2017/6751 to the JRC, the draft paper seems to have been received by DG
TRADE. However, this is not the case. Please note that when we retrieve non-pdf
electronic copies of emails (e.g. as part of replies to access to documents requests), the list
of recipients included in these emails is automatically updated in case certain recipients
have in the meantime moved from one DG to another. This means that the names of the
recipients do not change but the indication of their home DG may do. The recipient of the e-
mail in question, dated 25 October 2016, indicated as being in DG TRADE, was in fact
actually working in DG CNECT at that time.

As specified in Article 2(3) of Regulation 1049/2001, the right of access as defined in
that regulation applies only to existing documents in the possession of the institution.
Given that no such documents corresponding to the description in your application are
held by DG TRADE, we are not in a position to handle your request.
In accordance with Article 7(2) of Regulation 1049/2001, you are entitled to make a
confirmatory application requesting the Commission to review this position.
Such a confirmatory application should be addressed within 15 working days upon receipt
of this letter to the Secretary-General of the Commission at the following address:
