Dear Mr Teffer,
I refer to your application dated 8 January 2018, registered on 30 January under the
above mentioned reference number.
You requested access to 'All documents since 1 January 2016, including e-mails,
presentations and minutes, with references to the meetings of the EU-US Energy
Technology Working Group.'
We identified five documents falling under the scope of your request (hereinafter 'the
requested documents'), namely three email exchanges, one draft briefing and one draft

The requested documents contain pictures, names, surnames, functions, work addresses,
email addresses, CVs and other information on staff of the Commission and of external
entities. This information clearly constitutes personal data in the meaning of Art 2(a) of
Regulation (EC) 45/20011.

According to Art 8(b) of Regulation (EC) 45/2001, personal data shall only be
transferred to recipients if they establish the necessity of having the data transferred and
if there is no reason to assume that the data subjects' legitimate interests might be
prejudiced. Those two conditions are cumulative.
In the present case, you have not put forward any arguments to substantiate a need to
obtain these personal data. Furthermore, it cannot be assumed that such disclosure would
not prejudice the legitimate rights of the concerned persons. Therefore, personal data
have been withheld from the requested documents.
Nevertheless, in order to strike a fair balance between your right of access to documents
and the right to personal data protection, access was granted to the names and functions
of the staff in senior management positions at the Commission and to the names of the
main representatives of the external entities.
You may reuse the attached documents free of charge for non-commercial or commercial
purposes provided that the source is acknowledged and that you do not distort their
original meaning or message. Please note that the Commission does not assume liability
stemming from the reuse.
In accordance with Art 7(2) of Regulation 1049/2001, you are entitled to make a
confirmatory application requesting the Commission to review this position. Such a
confirmatory application should be addressed within 15 working days upon receipt of
