Dear Mr Bank,
I refer to your e-mail dated 27/08/2018 in which you make a request for access to
documents, registered under the above-mentioned reference number.
By your request you wish to receive access to the list of members of the following three
Comitology Commissions which fall under the remit of my Directorate-General:
- Committee on Regulation (EU) 2016/589 on a European network of employment
services (EURES), workers' access to mobility services and the further integration
of labour markets, and amending Regulations (EU) No 492/2011 and (EU) No
1296/20131;
- Committee for the technical adaptation of legislation on the minimum safety and
health requirements for improved medical treatment on board vessels, pursuant to
Council Directive 92/29/EEC of 31 March 1992 on the minimum safety and
health requirements for improved medical treatment on board vessels2;
- Committee for the technical adaptation of legislation on the introduction of
measures to encourage improvements in the safety and health of workers at
work3, covering several Directives including Directive 2009/148/EC of the
European Parliament and of the Council of 30 November 2009 on the protection
of workers from the risks related to exposure to asbestos at work4.
As for Regulation (EU) 2016/589 on worker mobility, the committee in question is the
EURES committee. So far, three meetings of this committee took place. For each
meeting, there might be different organisations representing the Member States.
Therefore, we refer you to the documents of the three individual meetings, as published

in the Comitology Register. In the summary record of each meeting, there is an annex
with the attendance list, specifying the Member States and the organisations representing
them in this specific meeting. You can access these attendance lists as follows:

3. In the window that appears, tick „Search for Dossier” in the line on top
4. Then go to section Committee/basic legal act
5. There click committee
6. In the box that appears select for DG responsible “DG Employment”
7. Click on search
8. In the list of committees that appear, click “committee EURES”
9. You are back now to document search. Click “search” again
10. Now you see you see the three meetings with related documents
11. In the summary record of each meeting, you can find in an annex, the respective attendance list,
specifying the Member States and the organisations representing them in this specific meeting.
As for the committees regarding Directives 92/29/EEC and 2009/148/EC, we regret to
inform you that the Commission does not hold any documents that would correspond to
the description given in your application. Indeed, both for the above-mentioned
Committee regarding Directive 92/29/EEC and for the one regarding Directive
2009/148/EC, no meetings have been held yet and no lists of members have therefore
been compiled. The Committees have been created for occasions where a legislative
procedure would require the use of such a committee. Such occasions may well present
themselves in the future.
As specified in Article 2(3) of Regulation 1049/2001, the right of access as defined in
that regulation applies only to existing documents in the possession of the institution.
Given that no such documents, corresponding to the description given in your
application, are held by the Commission, the Commission is not in a position to fulfil
your request.
In accordance with Article 7(2) of Regulation 1049/2001, you are entitled to make a
confirmatory application requesting the Commission to review this position.
Such a confirmatory application should be addressed within 15 working days upon
receipt of this letter to the Secretary-General of the Commission at the following address:
