PRES invited the delegations to endorse the compromise text tacitly. Nevertheless, a number
of delegations expressed their views – PL and NL issued a positive scrutiny reservation, BE
abstained (due to compromise agreement on risk management).
PRES concluded that further technical work will be undertaken in order to secure entry into
force on 1/1/2018 on the basis of the tabled compromise text.
Detailed comments
The PRES debriefed the delegations on the fourth trilogue on the agricultural provisions
of the Omnibus proposal which took place on 27 September 2017 and which resulted in
an agreement supported by all institutions.
In the ensuing debate, the majority of the delegations (FR, IT, ES, DE, LV, AT, FI, LU,
UK, EL, HU, IE, SK, CY) expressed their support for the compromise reached. BE
abstained, NL issued a reservation on the RD part (requesting the same wording as
regards the threshold for insurance and sector specific income stabilisation tool) and PL
issued a positive scrutiny reservation. DK and SE announced their final position will
depend on the overall compromise on the whole Omnibus package.
While DE accepted the new definition of permanent grassland, they asked for
clarifications of the effects of new the provisions (especially regarding clover). They also
requested the retroactivity point to be annexed to the SCA minutes. Similarly, FR also
announced their intention to include to the SCA minutes a statement from their side on
the Commission's statement on Producer co-operation.
The Legal Service of the Council also specified its position regarding the Commission's
statement on Producer co-operation (CMO – AM 129). In that statement the Commission
notes that the amendments agreed by the Parliament and Council are included without an
impact assessment as required by the Inter-Institutional Agreement on Better Law-
Making. In the Council's view, it is not a legal requirement to have an impact assessment.
A lot of delegations required clarifications regarding the next steps and timetable. In its
response, the PRES explained the aim is still to apply the new rules as from 1 January
2018 and that it deals with the package as a whole at the moment, despite delays in the
financial part of the Omnibus package (with financial trilogues planned for early
November 2017). In case a timely implementation is not achievable, the PRES
announced it will address the situation as appropriate and discuss the matters with the
colleagues dealing with the Financial Regulation.
Conclusions
The PRES concluded that the SCA took note of the outcome of the fourth trilogue and of
the support of the SCA regarding the overall compromise package agreed ad referendum
at the trilogue and its agreement that the necessary technical work can take place to
finalise the legal texts. The PRES also requested PL to come back on their positive
reservation within 48 hours (DL 18/10).

The next
SCA meeting will take place on 23 Oct. The meeting will include the Council
preparatory work such as 1) International trade, 2) Follow-up of Soil conference (PRES
discussion paper expected this week) 3) Commission explanations (background paper)
regarding Skimmed Milk Powder (SMP).
