As regards BCR
procedure, the ITS submitted a note relating to the impact of the Brexit for BCRs where the
ICO is involved in a case of a no deal scenario (see point (this note is discussed under point
2.3.1 of the agenda). In the case of a deal scenario, during the transition period (i.e. at least
until the end of December 2020), the EU data protection rules will continue to apply in the
UK. As a consequence, the transmission of personal data from the EU to the UK will not
constitute a transfer of data, and will therefore not require any transfer tools. At the same
time, as of the withdrawal date (30/03/2019), the UK will cease to be a member of the EU
and will no longer be part of EU decision-making processes. This means that the ICO will no
longer be a member of the EDPB. It will only be able to attend meetings of the Board on an
exceptional basis, upon invitation of the Chair and for the discussion of specific agenda points.
