1. Adoption of the Agenda
The agenda was approved.
2. Minutes of last meeting
Minutes were adopted in written procedure.
3. Privacy Shield
Discussion of draft report – rapporteurs: joint review delegation (
)
The EDPB report is planned to be adopted by the Plenary in January 2019. The parts of report prepared
by ITS and BTLE will be merged. The rapporteurs will work on the final version before Christmas.
Members of the subgroup should send their remaining comments to the draft report
by 20/12.
COM informed that an official adoption of the Privacy Shield report by the College of Commissioners
will happen on 19/12.
Additionally, the coordinator informed about the state of play of the first case which will be sent to
the Ombudsperson in the framework of the Privacy Shield.

4. Future of supervision models for EU large IT systems in the JHA area
Final:14/01/2019
Discussion of draft outline – rapporteurs:
The rapporteurs presented the outline of the document which was accepted by the subgroup.
Additionally, the Eurojust Regulation becomes applicable by the end of 2019. Other legal
basis for large scale IT systems will become applicable in 2020 and 2021.
5. EDPB Guidelines
Discussion of draft outline for opinion on Art. 47 LED – rapporteurs:
6. Discussion on Art. 48 GDPR/CLOUD Act
Continuation of discussion of draft comments and discussion on implications of CLOUD Act –
rapporteurs:
The members which took part in November’s meeting on an additional protocol to the Cybercrime
Convention in Strasbourg reported back about this meeting.
A new protocol will be probably ready for ratification by the end 2019.

7. BTLE Work Plan 2019
Discussion of the draft
Members discussed the draft on the Work Plan for 2019.
8. PNR
Discussion on state of play and next steps – rapporteurs:
For the next subgroup meeting the COM (DG Home) will be invited to provide a state of play on the
implementation of the PNR Directive, as well as on ongoing discussions on international agreements.
9. Any other business
The coordinator provided updates on the TFTP joint review and e-evidence proposals.
