Main issues discussed 
Eurocommerce represents European retail companies. Many retail companies have expanded and invested in distribution networks in other
Member States. The Eurocommerce representatives related to the COM services some of the issues perceived by a number of European
retailers active cross-border in particular in Central and Eastern European Member States. The reported concerns related for example to
sudden changes of the legislative framework, including measures indirectly discriminating foreign retailers. Furthermore, vague or unclear
legislation sometimes resulted in unpredictable and/or possibly disproportionate administrative decisions.  Eurocommerce also pointed out
some shortcomings in the law enforcement systems of some Member States as well as a lack of transparency of the decision making
process in certain national administrations. There is a worry that the climate might further deteriorate after the termination of intra-EU BITs.
Promoting and developing dialogue with national authorities, consulting stakeholders during the legislative process and preventing problems
at an early stage would be beneficial for all sides.  The Commission services took note of this practical feedback.
