Under the right of access to documents envisaged in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1. All documents showing the role of your Head of Cabinet Mr Martin Selmayr http://ec.europa.eu/commission_2010-2014... in a kind of "playhouse" about Financial Irregularities "directed" by Mr Morten Kjaerum. (I provide below full details).

In this personal email of Morten Kjaerum http://www.asktheeu.org/en/request/477/r... sent to Paul Nemitz, one of your directors for fundamental rights https://twitter.com/PaulNemitz it is described how Morten Kjaerum will pretend surprised in case Press media will contact him to ask how 400,000 Euro (1,000,000 DKK)disappeared under his tenure.

Dialogue no 1 of Morten Kjaerum, submitted for advice or consultancy/ approval to Paul Nemitz. The proposed acting is to show surprise in case press will contact Morten Kjaerum.

Morten Kjaerum wrote:

“If I am contacted I will shortly stress my surprise and that it is all new to me”.

This requires some good acting talent indeed, because we know from this private email http://www.asktheeu.org/en/request/477/r... that Morten Kjaerum was well aware about the financial irregularities, which he considers as being a “small amount” of 400,000 Euro. See page 1, last paragraph of Mr Kjaerum Email to European Commission.

Dialogue no 2 of Morten Kjaerum, proposing applying some kind of sands into the eyes of press:

Morten Kjaerum wrote:

“At the same time I will underline that it is a single incident in a big organization”.

In reality here it is about “a single incident” per year, in 12 years. So we have 12 incidents arrogantly called by Mr Kjaerum “accountants `creative` approach to financial administration”. See the first paragraph in page 2 of Morten Kjaerum email.

I see Morten Kjaerum attitude as striking contempt of the Danish taxpayers because Morten Kjaerum as Director of Danish Institute for Human Rights (DIHR) signed year by year, for 12 years or more, different accounting documents as balance sheets, loss and profit, turnover, and so on.
How did he sign those documents and how he was granted budgetary discharge?.

What is extremely striking from the EU taxpayer’s perspective, is that Morten Kjaerum brought DIHR to his current work place – EU Agency for Fundamental Rights and also to European Commission. Any of those “accountants `creative` approaches to financial administration” was declared by DIHR, as can be observed in several declarations by DIHR disclosed to ASKtheEU website and Morten Kjaerum, who was well aware as is clear from his private email to Paul Nemitz and your HEAD of cabinet Martin Selmayr, did not say a word. Lots of contracts were awarded by FRA http://www.asktheeu.org/en/request/funda... and European Commission http://www.asktheeu.org/en/request/477/r... (see page 3) in this mystification and deceitful conditions.

At the end of Morten Kjaerum` email is written:

“Martin Selmayr has been informed as well”.

I request access to the following documents and information:

2. Email/s or any other format of the Communication of Morten Kjaerum to Martin Selmayr in relation to financial irregularities at DIHR.

3. a) Documents showing the steps or measures taken by Martin Selmayr – if he informed you as Vice –president of the EU, responsible for human rights, fundamental rights and also FRA agency.

b)Documents showing the steps or measures taken by Paul Nemitz – if he informed the relevant hierarchy at FRA (chairwoman Maija Sakslin, executive board or governing board, if perhaps he informed you or your Head of cabinet Martin Selmayr.

4. All communications sent by you and/ or your Head of Cabinet to Anti-fraud Office in relation to DIHR situation (in the context that DIHR is contractor of FRA and EC).

5. All communication transmitted by Anti-fraud Office to European Commission (in any format: reports, Notes, phone notes, verbal notes, etc). Any Report by Anti-fraud Office drafted following any relevant investigation into financial irregularities at DIHR transported to FRA and European Commission.

6. All contracts awarded by European Commission to DIHR in last 12 years.

time limit is needed as your application concerns documents held by third
parties which need to be consulted.

We refer to your e-mail dated 2 November 2013 in which you make a request
for access to documents, registered on 12 November 2013 under the above
mentioned reference number, as well as to DG JUSTICE holding reply of 3
December 2013.

 

Your application is currently being handled. However, the various
documents you ask for are under the responsibility of different Commission
services and their retrieval from archives requires more time than
expected.

 

We are not in a position to complete the handling of your application as
indicated in the previous communication. Given the complexity of the
researches, a further extended time limit is needed.

 

Therefore, we have to extend the time limit in accordance with Article
