I submit today, 11/02/2020, via email this confirmatory application following the reply of Ms. Barbara Kampis received on 31/01/2020 with regards to my access to documents request under reference number Ares(2019)7592203 (Information about three H2020 projects at the field of technology-led policing in Greece, projects SPIRIT-786993, COPKIT-786687 and ANITA-787061). My application respects the 15 days deadline that REA has set.

To begin with, I have not received any information related to the project SPIRIT-786993. My request is related to “any pilot implementation of the project SPIRIT in Greece, as well as any publications on the use / development of tools related to face extraction and matching in Greece during the project.”

This project is a very important part of my request, since the Hellenic Police is one of the consortium’s partners. Moreover, the information available on the project's website is very limited, even though the project has been up and running since August 2018. Nevertheless, it is evident from the website's content that the project aims to use tools such as face extraction and matching, to correlate information from social media data, and to continuously initiate complex associative searches over all sources relevant to criminal investigation. Thus, access to the requested documents is needed so that the public will be informed about the context and the results of the ongoing assessments of SPIRIT.

Is SPIRIT using pilots in Greece to test the developed technologies, and what is exactly the role of the Hellenic Police in this consortium? Is the use of facial recognition technology and social media profiling by law enforcement authorities in a H2020 research project in compliance with the European law and what are the deliverables (legal and ethical analysis, for example) that deal with these aspects of the project?
If pilots have not been implemented yet, are they scheduled for the future? Again, I underline the fact that the website of the project does not have any information on the envisaged work plan, so I cannot make my request specific, asking about access on a specific deliverable.

These are important questions, but REA has not provided me any documents related to the project SPIRIT. Thus, everything about this project remains a secret (since no deliverables’ list exists in its website).
As to the protection of privacy and personal data, I fully endorse and accept all personal data to be blanked out from the requested deliverables. Thus, REA could made these documents available / partially accessible by crossing out any personal data in these documents.

As to the protection of commercial interests, public access to the documents requested does not undermine the protection of commercial interests and there is an overriding public interest in disclosure. All of the projects related to my request, are publicly funded projects. Thus, the public has a legitimate interest in accessing the results of publicly funded research. Maybe some of the deliverables could be protected under this argument, but a project such as SPIRIT cannot in its entirety be considered to be protected by the IP rights of the actors involved. Especially reports on legal and ethical analysis, use cases and scenarios, risk indicators, pilots’ evaluation reports and analysis, do not (or not mostly) contain commercial interests protected by Copyright.

Many thanks for your prompt and detailed reply to my application. I am very glad with all the information you provided about the project SPIRIT. All these important details are not available on the project’s website. So, I sincerely thank you for sharing them shedding some light upon the project .

Also, I am very glad to hear that the SPIRIT report of Legal and Ethical Framework and Risk analysis is publicly accessible. Unfortunately, the link you provided, i.e.
https://ec,europa,eu/research/participan... , does not properly work. It redirects me to the general participants’ portal of the Horizon 2020 Framework Programme (H2020), and when I search the “projects and results” section based on the project’s info (full name, abbreviation, project ID) I get no results for SPIRIT. Also, this deliverable has not been uploaded on the SPIRIT’s website (nothing is there basically).

Therefore, could you, please, attach this deliverable or provide a hyperlink that will correctly redirect me to it?

Moreover, I appreciate that you share with me as an attachment the table of the planned deliverables of the project. This could help our civil society organization to monitor the project’s progress in the future.

However, the second hyperlink you shared with me including all public deliverables produced to date and approved by REA that are already publicly accessible in the Community Research and Development Information Service (CORDIS), i.e. https://cordis.europa.eu/proiect/id/7869..., is broken too. More precisely, when I use it, I get the message “Page not found (404). We are sorry... the page you are looking for doesn't exist. It may have been removed, renamed or archived”.

Thus, could you please share a new hyperlink with me that works?
