Actions based on: REPORT FROM COMMISSION TO THE EParl, THE COUNCIL .. on the application of ..EC No 2201/2003 .. recognition and enforcement of judgements .. parental responsibility

Esperando una revisión interna por parte de Secretaría General de la Comisión Europea de cómo han respondido a esta solicitud.

Dear Secretariat General,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

in the report
"REPORT FROM THE COMMISSION TO THE EUROPEAN PARLIAMENT, THE COUNCIL AND THE EUROPEAN ECONOMIC AND SOCIAL COMMITTEE
on the application of Council Regulation (EC) No 2201/2003 concerning jurisdiction and the recognition and enforcement of judgements in matrimonial matters and the matters of parental responsibility, repealing Regulation (EC) No 1347/2000"

Brussels, 15.4.2014 COM(2014) 225 final

it is written:

"CONCLUSION
The Regulation is a well-functioning instrument that has brought important benefits to citizens. It has facilitated the settlement of increasing cross-border litigation in matrimonial and parental responsibility matters through a comprehensive system of jurisdiction rules, an efficient system of cooperation between Member State Central Authorities, the prevention of parallel proceedings and the free circulation of judgments, authentic instruments and agreements. The provisions on the return of the child complementing the 1980 Hague Convention aimed at deterring parental child abduction between Member States are regarded as particularly useful.
However, there are indications on the basis of data and preliminary feedback from experts that existing rules could be improved. In order to explore comprehensively the concerns identified in this report, the Commission intends to launch a further policy evaluation of the existing rules and their impact on citizens. To this end, the Commission will also launch a public consultation. On the basis of the evaluation and the replies to the public consultation, the Commission will take action as appropriate."

Therefore kind provide the information:

(1) when and through whom has this report been requested ?
(2) Who has prepared this report ?
(3) Quote: "there are indications on the basis of data and preliminary feedback from experts that existing rules could be improved" From whom and when was this information coming ?
(4) Quote: "the Commission intends to launch a further policy evaluation" Who made this decision and when ?
(5) quote: "To this end, the Commission will also launch a public consultation." Who and when was there a decision about the public consultation ?
(6) Quote: "On the basis of the evaluation and the replies to the public consultation, the Commission will take action as appropriate."
(6.1) What actions were taken ? Based on what results?
(6.2) Who has decided about the actions ?
(6.3) Are there user requirements for the actions ?
(6.4) Who is the project manager/responsible person ?
(6.5) Who is involved ? What DG's and members
(6.6) Who is involved from outside the commission ?
(6.7) Is the EU Parliament involved ?
(6.8) Whats the current project plan including hourly requirements of the people working this ?
(6.9) What are the expected expenses including working hours from EU employees and the detailed schedule with delivery dates/milestones ?
(6.10) Is the The Hague Office for child abduction involved ? What person ? Previous members ?
(6.11) Has there been any investigations about the profit for lawyers on child abduction returns and where the money for the returns is coming from
(6.12) Has there been an investigation how (through whom) child contact orders are enforced and who is paying for the enforcement of contact orders ?
(6.13) Are there any legal companies involved ?
(6.14) As there were big complaints about the United Kingdom in violation of EC2201/2003 are there measures taken that the influence of EU employees with UK nationality and consultants from UK is limited ? How is it ensured that there are no conflicts of interests and corruption in the work done ?
(6.15) Is DG equality involved when it comes to the discrimination of mainly boys but also girls in loosing or limited contact with their natural fathers ? It seems its a Gender issue.
(6.16) Have there been any investigations from the criminal law perspective when it comes to child abduction. It seems criminal justice never gets active on abduction cases.

Yours faithfully,

Klaus Zinser
