Advisory committee on harassment at the workplace finding

Dear European Parliament,

Gilles Bordelais is the second-place candidate running in the European Parliament elections for German Pirate party with a real chance of being elected. In February 2019, an advisory committee on harassment at the workplace found that aspects of Gilles Bordelais’ behaviour towards one employee should be classified as sexual harassment.

As he is a public figure and the issue was publicized by media, I am requesting (under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001) documents which contain information about the EP advisory committee finding.

I am not requesting any information which could identify the employee concerned, only the description of Mr. Bordelais' behavior and argumentation for the finding of the advisory committee.

Dear European Parliament,

Please pass this on to the person who reviews confirmatory applications.

I am filing the following confirmatory application with regards to my access to documents request 'Advisory committee on harassment at the workplace finding'.

On 3. 6. 2019, I received a letter denying my request stating four reasons:

1) Article 4(1) of Regulation No 1049/2001, arguing that granting my request would undermine privacy and the integrity of Mr. Bordelais. However, information about his behavior was subject to international media attention, so granting my request would not undermine his privacy any further. Should the Parliament find that in certain cases, Mr. Bordelais' right to privacy outweighs my right to information, these information can be omitted from the requested document(s).

2) Article 7 of Advisory comittee's internal rules which state that its deliberations shall be secret. However, I did not request to take part in a comittee's deliberation, so this Article has no relation to my request.

3) Article 4(3) of Regulation No 1049/2001 which allow for denying access to documents containing opinions for internal use as part of deliberations and preliminary consultations within the institution if disclosure of the document would seriously undermine the institution's decision-making process, unless there is public interest in the disclosure. As the Parliament failed to demonstrate that granting my request would seriously undermine the institution's decision-making process, the requested documents are not a part of deliberations nor preliminary consultations and there is public interest in disclosure, no part of this Article can be applied to my request.

4) Point b) of Article 9 of Regulation 2018/1725, arguing that transmission of information would not be proportionate. However, the Parliament failed to weigh competing interests in this case, and simply stating this reason as a fact doesn't allow me to provide any counterarguments.

Allow me to also state that if it wasn't for MEP Julia Reda who informed the public of Mr. Bordelais' behavior, he would have been elected and would be in a position of power towards female APAs and other staff for the next five years. Refusing my request on the grounds of lack of public interest is not only illegal, but I also find the current practice of covering up sexual harassment disgusting.
