Dear Mr Doherty,

You received a reply to your first request (Gestdem 2019/7355 enclosed) on 7 January 2020 (see enclosed).

As your second request (Gestdem 2019/7398 enclosed) seems to handle the same subject we suppose that both requests are replied to at this stage and that these two original requests mentioned above can be considered as closed.

In the rules for "access to documents" it is foreseen that the requestor can make a "confirmatory request" only after having received the reply by the Commission at the initial stage. You filed a "confirmatory request" (see below) without having received any replies from our side so we assume that the below demand (filed through "ask the EU") can be withdrawn.

Thank you for your email dated 13 January 2020. Unfortunately we cannot
acknowledge receipt of your confirmatory application, as our unit only
deals with confirmatory applications under Regulation (EC) No 1049/2001.
 
We have been informed by DG TAXUD that the 15 working days deadline under
the Code of Good Administrative Behaviour to respond to your request for
information submitted directly to DG TAXUD has not yet expired and that
you have already received a joint reply to your requests with our
reference numbers GESTDEM 2019/7355 and 2019/7398 .
 
Your initial request for access to documents 'Barriers to import of
processed cocoa products' which you submitted to DG AGRI, was forwarded to
the responsible Commission department, DG TAXUD, who subsequently handled
your requests as requests for information (Aarhus Convention) and not as
requests for documents under Regulation (EC) No 1049/2001 as the
information you requested is already available online.
