Dear Secretariat General of the European Commission,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

According to http://europa.eu/whoiswho/public/index.c..., the European Commission has a "Brexit Preparedness Group".

I am requesting all information all relevant information pertaining to the terms and the concepts of "preparedness" and "contingency" from that Group.

Information should be understood in a broader sense, including but not limited to letters, emails, drafts, memos, notes, databases, SMS, transcripts and so on.

I am requesting all information, including information not considered "important" under eDomec and other archiving rules.

In case information cannot be released, I am requesting the name and the registration number of the document that cannot be released.

The terms "preparedness" and "contingency" should also include those documents that contain all relevant information pertaining to these terms and concepts in languages other than English. I am pretty confident that the staff in the Brexit Preparedness Group has a sufficient clear understanding about the scope of the request with regards to these terms.

I understand that there has been some fluctuation in the staff of the Brexit Preparedness Group. For the sake of completeness, I am requesting information that includes those information written by former Brexit Preparedness Group staff or those working for the Brexit Preparedness Group on a temporary basis.

I do not believe that the SG of the European Commission has any right to request a postal address from me at this point based on Regulation 1049/2001. However, I do not wish to let them stall my request for this reason. So in order to have a speedy registration of my request, you are permitted to use the following postal address: Mathias Schindler, Büro Domscheit-Berg, MdB, Platz der Republik 1, 11011 Berlin, Germany. Please confirm that the SG does not require a postal address for the processing of access to information requests under Regulation 1049/2001 and that any such request is void.

thank you for your letter dated October 22.

As I understand it, you are seeking to extend the time limit for replying to my access to information request.

Such an extension in the initial application phase is possible under the conditions set out by Article 7 (3) of Regulation 1049/2001. It has to be an exceptional case, the applicant has to be notified in advance and detailed reasons have to be given.

Unfortunately you did not meet these criteria. You did not provide any information claiming that this request is by any standard exceptional and you did not provide reasons - detailed or not - explaining the delay.

As a consequence, you did not extend the deadline for handling the initial request.

The deadline has now expired and as per Article 7 (4) of Regulation 1049/2001, failure to reply within the prescribed time-limit has entitled me to make a confirmatory application which I am hereby doing.

I refer to your email of 23 October 2018, by which you intend to lodge a
confirmatory application in relation to your initial request for public
access to documents registered under Reference Gestdem 2018/5124, on the
basis of Article 7(2) of Regulation 1049/2001 regarding public access to
European Parliament, Council and Commission documents (hereafter
Regulation 1049/2001).

Your initial request was registered on 1 October 2018 and assigned to the
Brexit Preparedness Group.

Article 7(2) of Regulation 1049/2001 states that '[i]n the event of a
total or partial refusal, the applicant may, within 15 working days of
receiving the institution's reply, make a confirmatory application asking
the institution to reconsider its position'.

In your email, you seem to allege that the Brexit Preparedness Group of
the European Commission infringed Article 7(3) of Regulation 1049/2001 and
that this infringement is equivalent to a tacit refusal within the meaning
of Article 7(2) of the said Regulation which entitles you to submit a
confirmatory application.

According to Article 7(3) of Regulation 1049/2001, '[i]n exceptional
cases, for example in the event of an application relating to a very long
document or to a very large number of documents, the time-limit provided
for in [Article 7(1)] may be extended by 15 working days, provided that
the applicant is notified in advance and that detailed reasons are given'
(Emphasis added).

In this instance, the Brexit Preparedness Group of the European Commission
has not yet issued its reply in response to your application for access to
documents within the meaning of Article 7(2) of Regulation 1049/2001. In
fact, the Brexit Preparedness Group of the European Commission informed
you on 22 October 2018, that ‘due to ongoing consultations’ it had to
extend the deadline provided in Article 7(1) of Regulation 1049/2001 by
another 15 working days, in accordance with Article 7(3) of Regulation
1049/2001.

As a result, the new deadline for the handling of your request is 14
November 2018. Moreover, the Brexit Preparedness Group of the European
Commission provided a justification underlying the extension of the
deadline.

Against this background, it cannot therefore be concluded that the Brexit
Preparedness Group of the European Commission tacitly refused to reply to
your request within the meaning of Article 7(2) of Regulation 1049/2001
and did not provide any justification as to the extension of the deadline
until 14 November 2018.

Consequently, we conclude that your confirmatory application does not meet
the requirements set forth by Article 7(2) of Regulation 1049/2001 and the
Commission is therefore not in a position, at this stage, to handle your
confirmatory application.

We also would like to reassure you that your initial request is being
currently processed by the Brexit Preparedness Group of the European
Commission.

Nevertheless, we understand that you wish to be provided with a more
specific reasoning as to the extension of the deadline required for the
processing of your request. We have therefore forwarded your request to
the Brexit Preparedness Group of the European Commission, who will contact
you shortly in that respect.

Finally, we would like to reassure you that, , in accordance with Article
7(2) of Regulation 1049/2001, you remain entitled to submit a confirmatory
application, within 15 working days of the receipt of the Brexit
Preparedness Group’s initial reply regarding the substance of your
request, should you not be satisfied with the latter.
