Dear European Securities and Markets Authority (ESMA),

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I would like to request all correspondence, including emails, and notes or minutes from any meetings which discuss Carlos Tavares's appointment as vice president of ESMA, as it relates to Articles 11 and 11a of the Staff Regulations.

Specifically, what assessments have been made of Mr. Tavares' personal interests, considering his previous work for the financial private sector, helding senior positions in Banco Santander de Negócios, Banco Chemical Finance, Banco Pinto e Sotto Mayor, Banco Totta Açores and Banco Cisf, and are there any matters which he has been relieved from dealing with, under Article 11a 2 of the Staff Regulations.

I would firstly like to apologize for the delayed reply. Please find
attached a copy of the summary of conclusions of the ESMA Board of
Supervisors Meeting of 11.2.2011.

 

I may inform you that Art 11 and Art 11a Staff Regulation do not apply to
the Vice-Chairman of ESMA.

 

Mr. Tavares has accordingly not been relieved in application of Art 11a
para 2 EU Staff Regulations.

Dear Stephan Karas,

Firstly, I would like to thank you very much for your reply. However, please let me ask you for a further clarification. If I understood it correctly, Staff Regulations do not apply to the Vice-Chairman of ESMA. Therefore, could you please let me know which rules apply to this post in order to avoid conflicts of interests? Thank you very much for your consideration and your time.
