Consultation of Member States on 'European Adoptions' of children

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- all documents, correspondence, minutes related to the consultation of the Member States by the Judicial Network in Civil and Commercial Matters on the subject of legislation on (intra-community/European) adoptions and statistics on intra-community adoption of children.

By law DG JUST should have replied by 24 September 2013.

Subject:  Consultation of Member States on 'European Adoptions' of
children-GESTDEM 2013/4449

 

Dear Mr Dohle,

 

We have received your request of access to the following documents:

- all documents, correspondence, minutes related to the consultation of
the Member States by the Judicial Network in Civil and Commercial Matters
on the subject of legislation on (intra-community/European) adoptions and
statistics on intra-community adoption of children. 

 

From your e-mail of 26/9/2013 we understand that our holding reply did not
reach you. Probably for a technical problem from our side and we apologise
for this.

 

Your application is currently being handled. However, we have not been in
the position to complete the handling of your application within the
assigned time limit, which is 25 of September 2013.

An extended time limit is needed as your application implies a research in
the historical archives of the Commission and consultation of third
parties on the disclosure of the relevant documents.

We would like to ask for your understanding and indicate that we have to
extend the time limit with 15 working days in accordance with Article 7(3)
of Regulation (EC) No 1049/2001 regarding public access to documents. The
new time limit expires on 16/10/2013. Our department will do all the
necessary to provide you with a final reply within the new deadline.

 

We apologize for this delay and for any inconvenience this may cause.

I did not receive your original first holding reply probably for a technical problem from your side, for which you apologised on 27 September 2013 following my reminder from 26 September, by which you extended the time limit to 16 October 2013.

I hereby kindly inform you that this time limit expired.

Regulation No 1049/2001 regarding public access to European Parliament,
Council and Commission documents.

We enclose a letter and the requested documents which we hope will meet
your needs. 

I must however, remind you that it cannot be reproduced or disseminated
for commercial purposes unless the Commission has first been consulted.

Dear Secretariat General,

Please pass this on to the person who conducts Freedom of confirmatory applications.

I am writing to hand in a confirmatory application of Justice (JUST)'s handling of my FOI request 'Consultation of Member States on 'European Adoptions' of children'.

DG Just received a reply to their consultation from 11 Member States. Only 4 Member States agreed to disclosure of their document(s).

I hereby would like to request access to the other 7 Member States' documents. Failing so, I would be interested in the formal reason for non disclosure.
