In accordance with Regulation (EC) No 1049/2001 regarding public access to
European Parliament, Council and Commission documents, your application
will be handled within 15 working days. The time limit will expire on
6/11/2012 but due to the large number of documents requested this time
limit may be extended on the basis of Article 6 (3) of Reg. (EC)
1049/2001, which provides that "In the event of an application relating to
a very long document or to a very large number of documents, the
institution concerned may confer with the applicant informally, with a
view to finding a fair solution".
We are expecting from the responsible units of DG AGRI, that will treat
your requests, to tell us how much time is needed to identify and analyse
the documents and you will be informed in due course.

Further to my e-mail of 12th October 2012, I would like to inform you that
your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days.

 

After having received the feedback from the responsible units of DG AGRI
that treat your requests, I confirm that the handling of your requests
will take several months and an extended time limit is needed but it's not
possible to fix a specific deadline for the following reasons:

 

- Your application concerns a very large number of documents. Apart the
published documents that you have already received, there are
approximately 1364 documents which need to be assessed individually. Such
a detailed analysis brings an excessive workload that cannot be carried
out within the normal time limits set out in Article 7 of Regulation
1049/2001. The handling of your request involves the assessment of very
voluminous documents originating from third parties and several Member
States. The analysis of these documents, together with the need to make
around 200 consultations with the third parties and Member States
concerned, in accordance with Article 4(4) 4(5) of Regulation 1049/2001,
cannot be expected to be completed within the normal time limits set out
in Article 7 of Regulation 1049/2001.

For many of these documents, the Commission has committed to keep some of
the information confidential and has to contact each Member State, region,
NGO, citizen and other bodies, to request the permission to disclose their
documents.  Please note that it will not be possible to get in contact
with all of them because some of the contributions lack contact details.

Moreover, even if the Commission obtains the permission, a large number of
the contributions will have to be anonymised because of the commitment of
the Commission to protect the privacy and the integrity of the individual,
in accordance with Community legislation regarding the protection of
personal data. This means that all references to the contributor's
identity will be removed in many documents.

 

- In order to retrieve the documents requested, large files have to be
examined as well as older and actual databases of the Commission.

 

- Please note that for the request no Gestdem 2012/4684,The Future of the
"Most Deprived Persons Food Distribution" Programme there were 12.000
replies received to the on-line questionnaire for which we asked the help
of the computing service on the possibility of retrieving these data.

 

However, the Regulation also provides for a possibility to confer with
applicants in order to find a fair solution when an application concerns a
very large number of documents. Article 6(3) provides that "in the event
of an application relating to a very long document or to very large number
of documents, the institution concerned may confer with the applicant
informally, with a view to finding a fair solution".

 

Based on this provision, we would kindly ask you whether you could narrow
down the scope of your request, so as to reduce it to a more manageable
amount of documents. If that is not possible and if you maintain your
request for access to all documents concerned by your application, we
propose to handle your application in successive stages. If you accept
this proposal, you could indicate an order of priority, which we will
follow as much as possible in handling your application. If necessary, I
will inform you separately for the progress of each request. You will
receive, at regular intervals and separately for each request, batches of
documents which have been cleared for release or a reasoned reply
explaining why some documents cannot be disclosed.

 

If you are searching for specific information, please let us know, in
order to try to find if there is a different way to get this information.

In order to meet this request in the most satisfactory and efficient
manner, we would like to explain the procedure and seek your further
guidance.

 

1) We received more than 100 contributions in the consultation. These
contributions were provided in different EU languages.

 

2)  The Commission has committed itself to keep some of the information
confidential. The following statement featured in the Cover Note of the
consultation:

 

The results of the consultation will be reflected in the steering group's
report, which is due to be published in summer 2008. A summary of the
results will be published on this website. The information given will
remain confidential in line with Regulation 45/2001 and will not be
transferred to anybody. We guarantee that the answers will be anonymised.

Therefore, in order to provide the contributions to the review, the
Commission services will have to go back to each Member State, region,
NGO, citizen and other bodies who contributed to the review, and request
their permission to share their contribution with you.  It is presently
unknown to us what feedback we may receive, however, I wish to draw your
attention to the fact that some of the contributions lack contact details
and it will not be possible for us to get in contact with all
contributors.

 

3) In case the Commission services could obtain the permission, the
contributions will have to be anonymised. This means that all references
to the contributor's identity will be removed. Apart from the fact that
this will take several months, the contributions will not reveal their
content in their entirety.

 

Therefore, we would be most grateful if you could further define your

1. The preliminary document (from the EU bodies)
2. The opinions (or consults) received for the document during the consultant period. However, you may bypass those documents that are NOT in English. I will not be utilizing these.
3. The final document (from the EU bodies) that was officially released after the EU body took the third-party opinions into consideration.

My dominant issue is that these have not been made public, or even discussed, though these are all public documents.

the Commission has to consult the authors in order to request their
permission to disclose the documents. 

 

One of the organisations we consulted, Pan Europe from Belgium that agrees
to disclose its document, asked to know which is your identity. Could you
please indicate, as soon as possible, whether or not you agree to inform
this organisation on your identity? If your reply is positive, could it
apply to other similar requests we may receive?
