In addition to the request already placed with you and referring to Regulation (EC) No 1049/2001 on public access to EU documents and to the 'Aarhus Regulation' (see note 1), I would herewith like to ask for access to the following:

I would like to make clear I prefer you produce the documents on a rolling basis. At no point should the Commission’s search for—or deliberations concerning—certain documents delay the production of others that the Commission has already retrieved and elected to produce.

To the extent possible, I prefer the documents in electronic format.

Should my request be denied wholly or partially, please explain the denial or all deletions referring to specific exemptions in the regulation. Also I expect the partial release of documents, in case of partial exemption according to article 4.6. I reserve the right to appeal.

I'm sorry, that my request is still very broad. I'm happy to receive the
information in tranches. Would it be possible, that you focus the research
for documents concerning meetings and communication concerning the issue

Fertiliser Europe and Yara- so that these documents would definitely be
included in the first trance due end of July (provided the third party
consultation can be done by then)?

As a reply to our fair solution proposal, we take note of your agreement
to reduce the time frame for ETS related meetings and correspondence
(point 1) as from January 2008 to June 2015, and we thank you for that.
However, the scope of your request remains very broad and we will not be
in a position to reply to its entirety by the deadline set on 26 July
2017. We will make our utmost effort to provide you with a first tranche
of documents within this time period, namely the documents for which the
third party consultation and/or the internal coordination for agreement
of disclosure will already be finalised by then.

 

We propose two further deadlines for disclosure of the second and third
tranches of documents, which, would be respectively the 15 September
2017 and the 30 September 2017.

 

Alternatively, you can formally withdraw those parts of your request
that cannot be handled within the extended deadline (26 July 2017) of
Regulation 1049/2001, and re-introduce applications for access to these
parts in successive stages.
