Contacts with non-EU-countries on border security
Dear European Agency for the Management of Operational Cooperation at the External Borders,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
- minutes and other reports of meetings between FRONTEX officials and representatives of non-EU-countries in which the issue(s) of border security and/or border control and/or illegal immigration were discussed in the period between April 1st 2015 and today;
- all correspondence (including emails) between FRONTEX officials and representatives of non-EU-countries in which the issue(s) of border security and/or border control and/or illegal immigration were discussed in the period between April 1st 2015 and today.
Yours faithfully,
Mark Akkerman
Dear Mr. Akkerman,
Thank you for your email and your interest in Frontex activities.
We would like to inform you that pursuant to Article 2(1) of Regulation
(EC) No 1049/2001 of the European Parliament and of the Council of 30 May
2001 regarding public access to European Parliament, Council and
Commission documents, the right of access to documents is granted to a
citizen of the Union, and any natural or legal person residing or having
its registered office in a Member State.
Is it therefore necessary to confirm that you are invested in the right of
access to the documents requested, that is, with an ID
card/passport/residence permit in EU/registration in an EU Member State
(legal persons). You may however refuse to provide the above mentioned
document containing personal data; in that case, your request is not going
to be processed.
After receiving the above mentioned documents, we will be able to start
processing your request and will get back to you within 15 working days.
Please be informed of the following:
- The person responsible for controlling the personal data (Data
controller) is the Head of Legal Affairs Unit
- The personal data is collected for the exclusive purpose of assessing
the nationality of the applicant
- The recipients of the personal data are the 3 Frontex Staff members
(Senior Legal Officer, Junior Lawyer and Legal Assistant) handling
requests for public access for documents
- The personal data collected (that is, the document sent to the PAD
mailbox) will be deleted as soon as the access for the request document(s)
is granted or refused. In Frontex, this procedure takes no longer than 15
or 30 working days depending on the number/size of the requested
documents. During the processing of your data, you have a right to access
your data and rectify them if needed. You have a right to have recourse to
the European Data Protection Supervisor.
Thank you very much for your understanding.
If you will have any questions, please do not hesitate to contact us.
Kind regards,

Dear Mr Akkerman,
We have consulted our International and European Cooperation Unit on your application but unfortunately your request is too vague for any specific documents to be identified.
Pursuant to Article 6(1) of Regulation 1049/2001, applications shall be made "in a sufficiently precise manner to enable the institution to identify the document". Your application asking for all minutes and reports of meetings with third countries, as well as all correspondence with third country representatives covers almost the entire work of our International and European Cooperation Unit, and is impossible to meet as is currently phrased.
In order to assist you as best as we can, we kindly invite you to specify what it is you are most interested in, perhaps cooperation with a specific third country or specific activities or projects.
Once your application is specified, only then may we start processing it.
Thank you
Kind regards,

Dear PAD,
Thank you for your response to my request. To clarify this request, as you asked:
* It concerns the following list of countries:
- Egypt
- Eritrea
- Ethiopia
- Libya
- Mali
- Mauritania
- Morocco
- Niger
- Nigeria
- Senegal
- Somalia
- Sudan
- Tunisia
* and the following topics discussed:
- military and security cooperation in the field of border security/border management
- EU support (financial support, technical support, training) for military and security operations and purchases in the field of border security/border management
* this is for both bilateral and multilateral meetings, on political, expert and operational level
I hope this enough specificiation. Alternatively I could file separate requests for each of the countries mentioned above.
Yours sincerely,
Mark Akkerman
Dear Mr Akkerman,
Thank you for clarifying your request somewhat. Nevertheless, we require further assistance in order to proceed.
Firstly, the request does not reach the desired level of preciseness to enable us to identify the documents.
Furthermore, your application as it is currently phrased could target hundreds of documents. Pursuant to Article 6(3) of Regulation (EU) No 1049/2001, "in the event of an application relating to a very long document or to a very large number of documents, the institution concerned may confer with the applicant informally, with a view to finding a fair solution."
In view of the above, would you be available for a short telephone conversation to clarify your request and agree on how to proceed? If so, please provide us with your number.
Thank you for your understanding.
