Dear President,
On behalf of Corporate Europe Observatory (CEO), I would like to - under the right of access to documents in the EU treaties as developed in Regulation 1049/2001 - request access to the following documents:
- all reports (and other notes) from meetings between the European Commission and representatives of the tobacco industry (producers, distributors, importers etc, as well as organisations and individuals that are funded by and/or work to further the interests of the tobacco industry), during 2019.
- all correspondence (including emails) between the European Commission and representatives of the tobacco industry (producers, distributors, importers etc. as well as organisations and individuals that are funded by and/or work to further the interests of the tobacco industry), during 2019
- a list of all the above-mentioned documents (including dates, names of participants/senders/recipients and their affiliation, subject of meeting/correspondence)

There is a clear public interest in disclosure of these documents, with reference to the World Health Organisation's Framework Convention on Tobacco Control (Article 5.3) and its guidelines for implementation:
- “in setting and implementing their public health policies with respect to tobacco control, Parties shall act to protect these policies from commercial and other vested interests of the tobacco industry.”
- “Parties should ensure that any interaction with the tobacco industry on matters related to tobacco control or public health is accountable and transparent,” and “establish measures to limit interactions with the tobacco industry and ensure the transparency of those interactions that occur.”

thank you for your letter (SANTE.DDG1.B.2/SLO/mnd(2019)371471) responding to my access to documents request (Ref GestDem No 2019/7290). You suggest a fair solution in the form of narrowing down the request; I am happy to look for such a solution.

Please note that the motivation behind my access to documents request is to threefold:
- monitoring the role of tobacco industry lobbying in EU decision-making
- assessing the European Commission's compliance with Article 5.3 of the UN Framework Convention on Tobacco Control (UNFCTC)
- encouraging the Commission (across all Commission DG's) to follow the example of the Dutch government, which since 2016 has a central portal where it publishes all meetings, meeting notes and correspondence with the tobacco industry (across the government and its departments): https://www.rijksoverheid.nl/onderwerpen...

My suggestion for a fair solution would be to narrow down my request so your work would be limited to the following:
- identification of the documents falling under my request
- retrieval and establishment of a complete list of the documents identified

This would allow me (and others interested monitoring in tobacco industry influence) to submit follow-up requests for specific documents.

Please note that this proposal for a fair solution only applies to DG Sante (Ref GestDem No 2019/7290) and not the seven other Commission DGs that are covered by my access to documents request.

I understand that there are special circumstances related to ongoing competition law investigations. At the same time, the European Commission has the obligation to be as transparent as possible. There is moreover a very strong public interest in transparency around the Commission's contacts with the tobacco industry. This is clearly reflected in the European Ombudsman's 2016 decision concerning the European Commission’s compliance with the Tobacco Control Convention (852/2014/LP).

Please note that the motivation behind my access to documents request (and the ones focusing on seven other DGs) is threefold:
- monitoring the role of tobacco industry lobbying in EU decision-making

I refer to your email of 3 February 2020, registered on 5 February 2020,
by which you submit confirmatory application in accordance with Article
7(2) of Regulation (EC) No 1049/2001 regarding public access to European
Parliament, Council and Commission documents (‘Regulation 1049/2001’).

 

Your confirmatory application is currently being handled. Unfortunately,
we have not yet been able to gather all the elements needed to carry out a
full analysis of your requests and to take final decisions. Therefore, we
are not in a position to reply to your confirmatory requests within the
prescribed time limit which expires on 26 February 2020.

 

Consequently, we have to extend this period by another 15 working days in
accordance with Article 8(2) of Regulation (EC) No 1049/2001. The new
deadline expires on 18 March 2020.

 

I regret this additional delay and sincerely apologise for any
inconvenience this may cause.

I am filing the following confirmatory application with regards to my access to documents request 'Contacts with the tobacco industry during 2019'.

In December I submitted a request for access to documents, which was registered on 17/12/2019 under the reference number GestDem 2019/7297. On February 6th 2020, the Access to Documents Team of Directorate-General for Trade responded, apologising for the delay and informing me that they would double their efforts to finalise the reply. Four weeks later I have still not received any reply from DG Trade. This means almost three months have passed since my original request for access, which is clearly at odds with the deadlines and procedures outlined in Regulation 1049/2001..
