Correspondence and minutes related to the EU CO2 emission standards for new passenger cars

Dear Moblity and Transport,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

For the period between 1 January 2007 to date:

- a list of all meetings and/or calls held by the Directorate-General for Mobility and Transport, including any Cabinet Members and/or officials, with industry association representatives during which EU legislation on CO2 emission standards for cars and vans were discussed.
The list should include: date, individuals attending and organisational affiliation, as well as the issues discussed;

- all minutes and other reports of these meetings and/or calls;

- all documents prepared for the purpose of the meetings issued both in preparation and after the meetings took place.
- all correspondence, including attachments (i.e. any emails, mail correspondence or telephone call notes) between the Directorate-General for Mobility and Transport, including any Cabinet Members and/or officials, and any industry association representative discussing EU legislation on CO2 emission standards for cars and vans.

To the extent possible, I prefer the documents in electronic format.
Should my request be denied wholly or partially, I kindly request to explain the denial or all redactions referring to specific exemptions in the regulation. Also I would expect the partial release of documents, in case of partial exemption according to article 4.6.

Please confirm receipt of this application. I look forward to receiving your reply within 15 business days, as established by the regulation.

We refer to your e-mail of 5 November 2021, in which you make a request
for access to documents, found in the junk mail of the MOVE ACCES
DOCUMENTS functional box.

 

You request access to documents related to meetings “during which EU
legislation on CO2 emission standards for cars and vans were discussed”.

Please note, however, that EU legislation on CO^2 emission standards
should fall under the remit of Directorate-General for Internal Market,
Industry, Entrepreneurship and SMEs (DG GROW), of Directorate-General for
Climate Action (DG CLIMA) or of the Directorate-General for Environment
(DG ENV).

 

Indeed, the Directorate-General for Mobility and Transport (DG MOVE) is
not responsible for legislation concerning CO^2 emissions standards for
new passenger cars and for new light commercial vehicles, such as
Regulation (EU) 2019/631. This policy area does not fall under the mission
statement of DG MOVE.

 

For that reason, it is possible that DG MOVE may not be able to identify
relevant documents that would fall under the scope of your request, given
the improbability that any DG MOVE services or that Members of the Cabinet
of Commissioner Vălean held meetings or calls specifically on this
subject.

 

We would therefore please ask you to clarify, pursuant to Article 6(2) of
Regulation (EC) No 1049/2001 regarding public access to documents, whether
your request indeed concerns meetings held by DG MOVE, or if you would
like to reformulate your request in order to refer to meetings held by
other services of the Commission, such as DG ENV, DG CLIMA or DG GROW.

 

In case you indeed intend to request documents concerning meetings held by
DG MOVE, unfortunately, your description still does not enable us to
identify specific documents that would correspond to your request.

 

We therefore invite you, also pursuant to Article 6(2) of Regulation (EC)
No 1049/2001 regarding public access to documents, to provide us with more
detailed information on the documents that you seek to obtain. In
particular, we would be grateful if you could specify which stakeholders
you are interested in, and if possible, to narrow down the time scope of
your application, in order to allow us to define a concrete number of
documents.

I understand that the EU CO2 emission performance standards fall under the remit of DG Clima. In case there have been meetings or there has been correspondence with industry associations or companies and DG Move mentioning the terms "combustion engine cars" (or ICE vehicles) and "phase out" / "ban" or "restriction", I would be grateful if you could make them available. If there are no such documents, I thank you very much for your support and will consider this enquiry as closed.

Thank you very much for these additional clarifications.

You did not provide us with a specific time period for your reformulated request. In your previous request, you referred to all documents between 1 January 2007 to date.
However, as this is an extremely wide time period, the scope of your request must be reduced in a way that would enable its processing within the extended deadline of 15 + 15 working days.

We would therefore propose to narrow down the scope of your request in order to cover a period of five years up to date.

We kindly ask you to confirm your agreement to this arrangement.
