Au titre du droit d'accès aux documents dans les traités de l'UE, élaboré dans le Règlement 1049/2001, je demande les documents contenant ces informations:
- Documents se rapportant à des rapports ou procès verbaux des opérations d'interventions et de sauvetage ou récupération de dépouilles de naufragés Tunisiens ou maghrébins non identifiés sur les côtés italiennes.
- listings des rescapés et données sur les méthodes d'identification des sujets inconnus, rapports d'autopsie, relevés biometriques,et echantillons ADN ainsi que les adresses des institutions qui gadent les cadavres non identifiés.
Ainsi que les divers supports quI prouvent des tentatives d'identification envoyés aux autorités tunisiennes.

Dear Mr Badreddine,

 

With regard to your application for access to documents – namely:

-          reports or records from search and rescue operations or
recovery of unidentified bodies from Tunisian or north African shipwrecks
washed ashore the Italian coast

-          list of survivors and data on the methods for identification of
unidentified bodies, autopsy reports, biometric surveys and DNA samples,
as well as the addresses of the institutions that retain unidentified
bodies.

-          proofs that attempts for identification were forwarded to the
Tunisian authorities.

 

The Agency processed your application in line with the provisions of
Regulation (EC) No.1049/2001 of the European Parliament and of the Council
regarding public access to documents. As a result, please be informed that
EMSA’s mandate as strictly set out in its founding Regulation (EC)
No.1406/2002 of the European Parliament and of the Council establishing a
European Maritime Safety Agency (as amended) does not foresee the direct
involvement of the Agency in search and rescue operations at sea or
forensic tasks. Thus, EMSA does not have any documents that would contain
the information referred to in your message in its possession and is
therefore not in the position to satisfy your request.   

 

Note that, in line with Article 7(2) of Regulation (EC) No.1049/2001 of 
the European Parliament and of the Council regarding public access to 
documents, you may file a confirmatory application within 15 working days 
of receiving this email.
