Derogation for the greening measures of the CAP

Dear Sir/Madam,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, and Regulation 1367/2006, I am requesting documents which contain the following information:

All documents held by the Commission on derogation for the greening measures of the CAP from 22-03-2022 until 02-06-2023.

The reason for this request is a recent report by GLOBAL 2000 and other ngo’s called ‘Suspension of greening measures of the CAP under the guise of food security’. This report was about the effects of the derogation by the European commission called ‘Safeguarding food security and reinforcing the resilience of food systems’. The GLOBAL 2000 report was based on a powerpoint presentation called ‘State of play of the implementation of the greening derogations for 2022’, presented during the CGD on Environment and Climate of the 17th March 2023. On page 4 it says: ‘Main types of crops grown: maize, sunflower, (soya beans). Wheat in Northern MS’. Member States had to notify the Commission of the number of holdings which used the derogation and the number of hectares by December 15, 2022, the March 17 PowerPoint states.

Furthermore, GLOBAL 2000 found that only 0.6% of the land in Austria under derogation was used for producing grain for food.

The documents I'm interested in include but are not limited to, are:
* Datasheets, excel sheets, analysis of data, both aggregate data and on individual Member State level about the number of hectares used under the derogation and which crops were grown and whether these crops were for human consumption or were to be used as animal fodder;
* Communication, including draft versions, such as: exchanges via e-mail, including attachments, letter, text messages, or phone call notes within the Commission and between the Commission and member states about the aggregated data. In case a Member State did not notify the Commission, I would also like to receive all other data and communication;
* Meeting notes, powerpoints, presentations;

Since the information might at least partly also concern "activities affecting or likely to affect" the "state of the elements of the environment", I believe Regulation 1367/2006 applies.
Should you encounter any difficulties in interpreting or processing my request, I am ready to discuss ways to clarify or amend it to keep the effort required on your part to the necessary minimum.

I understand you may need to consult 21 individual Member States that applied for the derogation and that this may take a while. I kindly request you to send me all the information you have found after 30 working days have elapsed. Afterwards you may send additional information in batches.

Please send me an acknowledgement of receipt for this request, as foreseen by Article 7 (1) of Regulation 1049/2001. I would appreciate it if you could send a list of documents that correspond to my request. Please note I prefer to receive the documents in digital format, not by physical mail.
