We refer to your e-mail dated 07/09/2017 in which you make a request for

reference number.  We also refer to our request for clarification of 20
September 2017 (our Ref. Ares(2017)4600370) and to your reply of 21
September 2017 (our Ref. Ares(2017)4934739).

Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires on 12/10/2017.           

An extended time limit is needed in order to retrieve the documents
requested.  

Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 06/11/2017.

We apologise for this delay and for any inconvenience this may cause.

Please find this as a confirmatory application to request the document requested, namely the "mission letter" initially referred to in GESTDEM 2017/5088. This "mission letter" was apparently attached to the email which formed annex 1 of the reply to me of 6 November 2017. DG CNECT described annex 1, at the time, as:

My reasons for making a confirmatory application are as follows:

- DG CNECT shoud have provided the mission letter as part of its original answer to GESTDEM 2017/5088, or explained at the time why it was not to be provided
- It seems to me highly unlikely that the whole content of the mission letter is "commericially sensitive" as has been stated. Surely it is possible to redact, if necessary, commercially sensitive parts, in order to release the rest of the letter which would provide greater clarity. For example, based on the information in annex 1, it is not clear whether the "mission letter" referred to was from DigitalEurope to PWC, or from the Estonian Presidency/ Commission to DigitalEurope. Either interpretation is possible and clarity is important.
- Whether the "mission letter" itself was from DigitalEurope, or from the Estonian Presidency/ Commission, it is clear that DigitalEurope was mandated by the Estonian Presidency/ Commission to carry out some work, and it would be important that maximum information about this is put into the public domain. The mission letter would surely help with that and there is a clear public interest case to be made for its release.
- I am not requesting the personal data mentioned in your letter such as a staff signature. In my view, the name and function of the staff signatory should not be viewed as confidential.
