a request for access to documents, registered under the above mentioned
reference number.

Your request is as follows:

Under the right of access to documents in the EU treaties, as developed in
Regulation 1049/2001, I am requesting documents which contain the
following information:

 

A list of all lobby meetings held by the vice-president and the
commissioner in charge of Financial Stability, Financial Services and
Capital Markets Union, or any other member of their Cabinet with any
organisations representing churches and/or religious communities since
2014 onwards, including all emails, minutes, reports or any other briefing
papers related to all those meetings.

 

After a search, 2 documents of correspondence between the Head of the
Cabinet Dombrovskis - Mr Kai Wynands and COMECE (Commission of the
Bishops' Conference of the EU) have been identified as falling within the
scope of your request.

Having examined the documents requested under the provisions of Regulation
(EC) No 1049/2001 regarding public access to documents, I have come to the
conclusion that they may be partially disclosed. As regards to the agenda,
we have blanked out those parts of the agenda which were not linked to the
discussion with Mr. Wynands. In addition, some parts of the documents have
been blanked out as their disclosure is prevented by exception to the
right of access laid down in Article 4 of this Regulation, for data
protection reasons.

Personal data can only be transmitted under specific exceptional
conditions, including if ‘the recipient establishes that it is necessary
to have the data transmitted for a specific purpose in the public
interest. According to Article 9(1)(b) of Regulation 2018/1725, the
European Commission also only has to examine the further conditions for a
lawful processing of personal data if the recipient has established that
it is necessary to have the data transmitted for a specific purpose in the
public interest. In your request, you do not put forward any arguments to
establish the necessity to have the data transmitted for a specific
purpose in the public interest.

Notwithstanding the above, please note that there are reasons to assume
that the legitimate interests of the data subjects concerned would be
prejudiced by disclosure of the personal data reflected in the documents.

Consequently, I conclude that, pursuant to Article 4(1)(b) of Regulation
1049/2001, access cannot be granted to the personal data, as the need to
obtain access thereto for a purpose in the public interest has not been
substantiated and there is no reason to think that the legitimate
interests of the individuals concerned would not be prejudiced by
disclosure of the personal data concerned.

Should you disagree with the assessment that the redacted data are
personal data which can only be disclosed if such disclosure is legitimate
under the applicable rules on the protection of personal data, you are
entitled, in accordance with Article 7(2) of Regulation 1049/2001, to
submit a confirmatory application requesting the Commission to review this
position.

Such a confirmatory application should be addressed within 15 working days
upon receipt of this letter to the Secretariat-General of the Commission
at the following address:

We refer to your e-mails  dated 9 April 2019 in which you make several
requests for access to documents, registered under the above-mentioned
reference numbers.

Your requests concerns 46 meetings and is divided in 5 requests which need
to be assessed individually. And we are currently dealing with another
request 2019/1899 sent by you on 28/3.

In addition to that, the handling of your requests involves the assessment
of a large number of documents originating sometimes from third parties.
The analysis of these documents, together with the need to consult the
third parties concerned in accordance with Article 4(4) and 4(5) of
Regulation 1049/2001, cannot be expected to be completed within the normal
time limits set out in Article 7 of Regulation 1049/2001.

However, the Regulation also provides a possibility to confer with
applicants in order to find a fair solution when an application relates to
a very long document or concerns a very large number of documents. Article
6(3) of the Regulation provides that the institution concerned may confer
with the applicant informally, with a view to find a fair solution.

 

In accordance with the case law of the EU Courts, such a solution can only
concern the content or the number of documents applied for, not the
deadline for replying. This means that the scope of the request must be
reduced in a way that would enable its treatment within the extended
deadline of 15 + 15 working days.

 

Based on the above-mentioned provision, we would kindly ask you to specify
the objective of your request and your specific interest in the documents
requested, and whether you could narrow down the scope of your requests
(number of documents requested), so as to reduce it to a more manageable
amount of documents.

Our Cabinet and DG FISMA coordination unit should be involved in the
treatment of your requests (among other tasks and other requests) which
implies an additional amount of work.

 

According to our first estimates, the handling of your request would take
56 working days, divided as follows:

-          identification of the documents falling under your request: 5
working days;

-          retrieval and establishment of a complete list of the documents
identified: 10 working days;

-          scanning of the documents:3 working days;

-          assessment of the content of the documents in light of the
exceptions of Article 4 of Regulation 1049/2001: 10 working days:

-          third-party consultations under Article 4(4) and/or 4(5) of
Regulation 1049/2001: 10 working days;

-          final assessment of the documents in light of the comments
received: 2 working days;

-          drafting of the reply: 1working day;

-          redaction of those parts of the documents to which one or
several exceptions apply): 5 working days;

-          internal approval of the draft decision on your request: 5
working days;

-          preparation of the reply and the documents for dispatch
(scanning of the redacted versions, administrative treatment, 5 working
days.

It follows that, according to our estimates, a maximum of 20 documents
could possibly be dealt with within the extended deadline of 30 working
days counting from the date of registration of you application.

In order to meet the established limit, we would propose for these
requests to deal with the request 2019/2240 concerning the DG and another
set of documents indicated by you.

 

In order to enable us to respect the time-limits of Regulation 1049/2001,
we would ask you for a swift reply to our proposal of a fair solution,
within five working days at the latest:
