Dear Ms Cann,

We refer to your request for access to documents, registered under the
above-mentioned reference number, and also to our holding reply of 24 July
2020, our reference Ares(2020)3909054.

Your application is currently still being handled.

We noticed that in response to your closely linked parallel requests to a
number of other Commission services you have already received a number of
documents (e.g. GestDem 2020/4018).

However, for our DG we have not yet been in a position to complete the
handling of your application GestDem 2020/4017 within the time limits
foreseen.

We are trying our best to finalise our response to you speedily and to
provide it to you as soon as possible, with the resources available under
the current situation.

In this context, please be informed that the Commission has taken
precautionary measures to contain the spread of the COVID-19 virus and
reduce the risk of infection of our staff, while ensuring business

teleworking. This may have an effect on the physical search of documents
and internal/external consultations. As a consequence, the procedure to
handle your applications may take longer than foreseen.

We apologise for this delay and for any inconvenience this may cause.

Dear Ms Cann,

Please find attached document Ares(2020)5027796 regarding "Your application for access to documents – GestDem 2020/4017" sent by Mr Roberto Viola, General Director of DG CONNECT on 25/09/2020.

DG CONNECT — ACCESS TO DOCUMENTS

Dear Communications Networks, Content and Technology,

Thank you for the reply dated 25/9/2020 regarding GESTDEM 2020/4017.

I note that the reply says "Accordingly, the response of DG CONNECT concerns only the area for which DG CONNECT was lead service within the Commission. As regards the remit of DG CONNECT, we regret to inform you that we do not hold any documents that would correspond to the description given in your application."

But in fact, the scope of my initial query was about any lobby contacts that DG Connect had had regarding the Digital Services Tax. The remit of DG Connect is not relevant and I am concerned that your interpretation of my request could end up excluding some documents relevant to my request.

Please could you clarify whether there are some documents which indicate lobbying of DG Connect on the digital services tax but which have been excluded from the scope of your answer?

Thank you in advance.

Yours faithfully,

Vicky Cann

Dear ve_cnect.public_access_to_documents(CNECT),

Thank you for the reply and documents.

If you could always check that you are posting the documents to the correct request on Ask the EU, that would be super helpful. In fact these were initially posted to 2020/5258 which is a different request, on a different theme, to a different DG.

Thanks again.

Dear [email address],

Thank you for the documents to 2020/4017 that I have now receieved.

Please note that in the past few days you have been posting your responses to 4017 to the wrong Ask the EU request and that has required Ask the EU to manually move the emails and documents.

It is really desirable and helpful if the Commission could ensure that the correct response is posted to the correct request. If you need to reply again to this request, kindly use [email address]

Thank you very much.

Yours sincerely,
