Dear Mr de Clerck,

We refer to your email of 26 October 2021 in which you make a request for
access to documents, registered on 27 October 2021 under the
above-mentioned reference number.

The description given in your application makes it very difficult for us
to identify concrete documents in DG TRADE, which would correspond to your
request.

We also note that you have submitted identical applications to other
Directorate-Generals of the Commission, like DG ENER and DG CLIMA (Gestdem
2021/6378 and 2021/5965).

We therefore invite you, in accordance with Article 6(2) of Regulation
(EC) No 1049/2001 regarding public access to documents, to provide us with
more specific and detailed information on the documents you request. In
order to properly address and allocate your request as far as DG TRADE is
concerned, we would like you in particular to kindly further specify any
concrete references, dates or limited time periods during which the
documents would have been drawn up, originators or recipients of the
documents, or any specific stakeholders/third parties involved etc. you
have in mind.

If you need assistance in clarifying or specifying your application, you
can contact us by email to: [1][DG TRADE request email].

In accordance with the third paragraph of Article 2 of the Detailed rules
for the application of Regulation (EC) No 1049/2001 (Official Journal
OJ L 345, 29.12.2001, p. 94), the deadline of 15 working days for handling
your application will start running only, once we receive your
clarifications – different from the earlier indication you received via
the acknowledgment email sent to you on 27 October 2021, our reference
Ares(2021)6612689.

Kindly reply to us with your clarification email by Wednesday 10 November
2021.

Thank you in advance for your understanding and your kind cooperation.

Yours sincerely,

Dear [email address],

I can limit the requests to fossil fuel companies, trade associations with fossil fuel companies in their membership, consultancies and law firms working for fossil fuel companies and law firms or other companies engaging in investor state dispute settlement.

The time period from January 2020 was explicitly chosen as this was the start of the negotiations to modernise the ECT.

Yours sincerely,

Paul de Clerck

Dear Sir,

We refer to your e-mail of  26 October 2021 in which you make a request
for access to documents, registered on 27 October 2021 under the above
mentioned reference number, and to your answer to our clarification
request of 3 November 2021.

Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires on 18 November 2021.

An extended time limit is needed as the application concerns documents
held by different Services, which must be consulted.

Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 09 December
2021.

We apologise for this delay and for any inconvenience this may cause.

Yours sincerely,

Please note that, according to our standard operational procedure, the reply is usually also sent to you by registered post. However, due to the extraordinary health and security measures currently in force during the COVID-19 epidemics, which include the requirement for all Commission non-critical staff to telework, we are unfortunately not in a position to follow this procedure until further notice.
We would therefore appreciate if you could confirm receipt of the present e-mail by replying to [DG TRADE request email].

Thank you.
