Asuntos Marítimos y Pesca no tenía la información solicitada.

Dear Maritime Affairs and Fisheries,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

For the period between 1 January 2020 to date:
All documents - including but not limited to policy papers, proposals, briefings, reports - which have been produced and/or issued by DG MARE and include any of the following words/phrases: “deep-sea mining”, “seabed mining”, “marine minerals”.

I would prefer to receive the documents on a rolling basis, in case the Commission’s search for, or deliberations concerning, certain documents delay their individual release.

To the extent that it is possible, I prefer to receive documents in electronic format.
Should my request be denied wholly or partially, I kindly request to explain the denial or all redactions referring to specific exemptions in the regulation. Also I would expect the partial release of documents, in case of partial exemption according to article 4.6.

Please confirm receipt of this application. I look forward to receiving your reply within 15 business days, as established by the regulation.

Yours faithfully,

Matteo Civillini

Dear applicant,

Please find attached reply to your request registered under GestDem
2021/0579.

According to standard operational procedure, the reply is usually also
sent to you by registered post. Please note, however, that due to the
extraordinary health and security measures currently in force during to
the COVID-19 epidemics, which include the requirement for all Commission
non-critical staff to telework, we are unfortunately not in a position to
follow this procedure until further notice.

We would therefore appreciate if you could confirm receipt of the present

Thank you.

Dear [email address],

Thank you for your reply.

However, I wish to point out that there must be a few mistakes in your reply.
First of all, your reply does not include a formal letter explaining which documents have been released.

I can only see two documents, which are named "Annex 3" and "Annex 4". This suggest that you should have sent me at least two more documents (presumably "Annex 1" and "Annex 2"). Additionally, the document title "Annex 3" cannot be opened. As you can see, the attached file weighs 0 Kbytes, there must have been an error in uploading it.

I kindly request to rectify your reply as soon as possible.
It is rather disappointing that, despite a long extension beyond the deadline established by law, you response is still inadequate.

Yours sincerely,

Dear MLCUCHOVA Katarina,

I can only repeat the same message as above, as nothing has changed in your latest response.

One of the files attached cannot be opened.

Your reply does not include a formal letter explaining which documents have been identified and released.

The two documents attached are named "Annex 3" and "Annex 4". This suggest that you should have sent me at least two more documents (presumably "Annex 1" and "Annex 2").

Please rectify as soon as possible or I will be forced to request an internal review.

Dear Maritime Affairs and Fisheries,

Please pass this on to the person who reviews confirmatory applications.

I am filing the following confirmatory application with regards to my access to documents request 'Documents on Mining Policy'.

Despite repeated clarifications and polite follow-ups on my part, the authority has been unable to provide a satisfactory response to the request.

As i pointed out on multiple occasions to the officer, the reply sent to me presents the following problems, which undermine the credibility of their response:

1. The reply does not include a formal letter explaining which documents have been identified and released.

2. The two documents attached to the response are named "Annex 3" and "Annex 4". This suggest that they should have sent me at least two more documents (presumably "Annex 1" and "Annex 2").

3. One of the two annexes attached to their response is a corrupted file and therefore cannot be opened.

Dear Maritime Affairs and Fisheries,

Please pass this on to the person who reviews confirmatory applications.

I am filing the following confirmatory application with regards to my access to documents request 'Documents on Mining Policy'.

I object to the decision to grant no access, including partial access, to the documents under category C, ie documents from 10 to 16. While acknowledging the presumed confidential nature of parts of those documents, I also argue that the authority should not apply a blanket ban on disclosure of such documents.

The authority should reconsider a partial disclosure of the documents, considering the overriding public interest in the matters discussed. As scientific research (including the EU-funded one) shows, deep sea mining may risk threatening the marine environment and, as a directly consequence, humanity at large. As such, the highest degree of transparency should be applied to documents discussing such matters.

7(2) of Regulation (EC) No 1049/2001 regarding public access to European
