Dear European Parliament,

Thank you for your reply. I take note of your position that you consider this file closed, however I do not agree that the relevant information requested has been provided to me. I request that my application be reopened and an internal review carried out. Below I outline the reasons for my request of review.

My request sought access to committee reports for the negotiations of Directive 96/71/EC. Negotiations on this directive took place between 19/06/1991 (when the original proposal was tabled by the European Commission) and 16/12/1996 (when the act was formally approved via the co-decision procedure by the presidents of the Parliament and the Council). The first four documents you refer to your in reply do not concern this Directive, nor the relevant procedure, in this case procedure Procedure 1991/0346/COD. Rather they all appear to relate to subsequent reviews of Directive 96/71/EC's implementation or subsequent amending acts. Therefore these documents do not relate to the legislative negotiations of Directive 96/71/EC. They are not the files I requested in my previous correspondence and therefore my request has not been fulfilled.

Additionally, with regard to the trilogy negotiation documents, and additional documents, you refer to these do not pertain to the specified negotiations for Directive 96/71/EC. Rather again they concern subsequent subsequent reviews of Directive 96/71/EC's implementation or subsequent amending acts of that legislative act. In particular their procedural record numbers to no refer to the correct legislative procedure, in this case procedure 1991/0346/COD. They are not the files I requested in my previous correspondence and therefore my request has not been fulfilled.

I ask that the response to my request be reviewed and the relevant documents shared. Again I would stress that I am seeking only documents relating specifically to the negotiations of Directive 96/71/EC, between 19/06/1991 and 16/12/1996, under the relevant procedure (1991/0346/COD). I am not seeking committee reports or trilogue documents for subsequent amending acts which altered Directive 96/71/EC, I am only seeking the documents which pertain specifically to the negotiations of Directive 96/71/EC itself.

we would like to inform you that he EMPL Committee's deposits in the
Archives of the European Parliament contain documents that are limited to
the preparation and approval of parliamentary reports. The minutes of the
committee meetings do not contain any references to the state of
negotiations with the Commission and the Council. At the time, these
documents were probably destroyed or had no documentary record of the
meetings, which were informal, so very few records of the conciliation
reached the Archives.

can find in the attachment.
