Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Minutes of all meetings of EMC AdCo in which the subject of Solar photovoltaic (Solar PV/ solar energy) installations are discussed with regard to electromagnetic compatibility, dating from 2011.

Any documents or emails which explore decisions or recommendations to change the status (or category) of solar PV installations so that these are no longer considered 'Fixed Installations' with regard to the EMC Directive.

In accordance with Regulation (EC) No 1049/2001 regarding public access to

Dear Sir / Madam,

 

We refer to your request dated 20/11/2013 in which you make a request for
access to documents, registered on 21/11/2013 under the above mentioned
reference number.

 

Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires on 12/12/2013.

 

An extended time limit is needed as the documents requested originate from
third parties which have been consulted and we are still waiting for their
reply.

 

Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 14/01/2013.

 

We apologise for this delay and for any inconvenience this may cause.

Thank you for your prompt reply and your agreement.

Please note that DG ENTR contacted the III. party immediately (the Chair of ADCO) in November 2013. As you may know all ADCO meetings are meetings of enforcement authorities and the items discussed there are very often sensitive information. ADCO made an official inquiry to all its members and it is waiting for their agreements with disclosure of the requested documents.

On 11/12/2013 we sent you a holding reply where we informed you about the new extended deadline which according to access to documents rules will expire tomorrow 14/01/2014 (only the working days are counted in this deadline and the Commission was closed between 21/12/2014 until 02/01/2014 including).

Dear Mr. Coleman,

 

We are coming back to you after our last letter dated 16/01/2014
(Ares(2014)84930).

Following our contact with ADCO members, as promised, I send you the
extract of the minutes of ADCO meetings, concerning the topic of your
request ( Solar photovoltaic installations) :

“Minutes of all meetings of EMC ADCO in which the subject of Solar
photovoltaic (Solar PV/ solar energy) installations are discussed with
regard to electromagnetic compatibility, dating from 2011”.     

 

Concerning your second request:

“Any documents or emails which explore decisions or recommendations to
change the status (or category) of solar PV installations so that these
are no longer considered 'Fixed Installations' with regard to
the EMC Directive.”

 

There is indeed no such documents existing, but your request raise in ADCO
a discussion on this topic, and EMC ADCO group will discuss the
issue/status of fixed installations during the next EMC ADCO meeting.

 

So as we previously sent to you the statement that  “In the opinion of EMC
ADCO Solar PV installations are considered as "fixed installations" and a
change of this policy is not foreseen (also not in the revision of the EMC
Directive which takes place at the moment). Other New Approach Directives
may consider the nature of Solar PV installations different.”

 

This point will be discuss as all members were agree with this statement
but one only disagree.

 

So as we advise in our letter, the best thing is to contact directly the
ADCO group, the Chairman Mr. Winkelmann in order to have more precision on
this topic.
