ERT meetings with DG Energy 1992-1995

Dear Energy (ENER),

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting a list of all meetings between the European Commission (DG Energy, the secretariat general and the president of the Commission) and the European Roundtable of Industrialists (ERT) between 1992 and 1995 during which energy policy was discussed.

I would appreciate if you could disclose the dates that such meetings took place and the Commission's officials with whom the ERT met.

Are you telling me that access to 'information' falls under a different category than access to 'documents'?

In my request I do not ask for a 'document' as such, but access to 'information' concerning meetings between the ERT and the Commission between the dates indicated. I understand this to be a right of mine.

In many documents the Commission itself acknowledges meetings with the ERT over energy policy during that time frame. I am asking therefore for a complete list of such meetings (as indicated in my original request).

Dear Ms Bizzarri,

Under Regulation 1049/2001 on access to documents, the applicants may request access to a "document" - whatever its form be - see Article 3(a) of the Regulation. The requested document must exist at the time the request is made and must be in Commission's possession. The Commission services are not required to produce a new document, following the applicant's request. Therefore, requests for access to documents under Regulation 1049/2001 should refer to a specific document(s) and not to "information" in broad sense.

For your future requests you may consider using directly the electronic form for entering requests for access to documents:

We would like to strongly advise the use of the above form in the future as only registration in this way can ensure smooth and timely handling of requests.

Dear Energy (ENER),

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Energy (ENER)'s handling of my FOI request 'ERT meetings with DG Energy 1992-1995'.

I have placed similar requests in the past to other DGs and never had a problem concerning the request to collate existing data into a new document.

I feel that DG Energy is trying to obstruct the public's access to information in complete contradiction with the objectives of the Aarus Convention and the Commission's own good governance practice, which aim to guarantee citizens' right to transparency.

I sincerely hope that you will deem DG Energy's response unsatisfactory and will ensure that my request is acted upon as a result of this review.
