two requests for public access to documents under Regulation (EC) No
1049/2001.

 

As a preliminary remark, kindly note that in the present case you have

Please note that your applications are currently being handled by the EUAA
in accordance with Regulation (EC) No 1049/2001 and the Agency’s
Management Board Decision No 6. However, the Agency will not be in a
position to complete the handling of your applications within the initial
timeframe of 15 working days, which was due to expire on 7 December 2022.

 

An extended period is needed due to additional administrative efforts and
internal consultations being required by the EUAA, in order to be able to
duly process your requests in the most diligent manner (in accordance with
the principle of good administration).

 

In light of the above, the Agency has decided to extend the time limit by

Dear Mr Ambri,

 

With reference to your application for public access to EUAA documents
(ref. no 000696) under Regulation (EC) No 1049/2001, Article 6(3) of the
latter provides that “[i]n the event of an application relating to a very
long document or to a very large number of documents, the institution
concerned may confer with the applicant informally, with a view to finding
a fair solution”.

 

Following a preliminary assessment of your request, the Agency has
identified a large number of EUAA training modules, covering almost the
totality of the EUAA Training Curriculum (as shown in the attached
Training Catalogue), which would be covered by your request. For each of
these training modules, different documents have been developed by the
Agency which could fall under the notion of “training material”. The type
of training documents produced for each module depend on factors such as
for example the specific subject covered, the learning strategy for the
module as well as the mode of delivery.

 

The wide scope of your request implies that the Agency will be subject to
a disproportionate administrative burden in handling the request, making
it impossible to comply with the current extended deadline of 6 January
2023.  

 

In order to enable you to be able to reach a fully-informed view in this
sense, please note that:

 

•            Individually processing (i.e. thoroughly reviewing these
documents against potential exceptions under Article 4 of Regulation (EC)
No 1049/2001 and inserting any redactions in) all training documents would
require a (very) high allocation of staff-resources. Moreover, those
staff-resources would need to be knowledgeable both on Regulation (EC) No
1049/2001, as well as the EUAA Training Curriculum;

•            The Agency does not have sufficient number of such
staff-resources;

 

The Agency would therefore like to invite you to clarify or reduce the
material scope of your application. In order to assist you to better
identify the training modules that could be of interest to you, we have
compiled two lists of modules in accordance with the categories specified
in your request, as follows:

 

(i)                  A list of EUAA training modules followed by Cypriot
Asylum Service employees;

(ii)                A list of EUAA training modules followed by members of
the Asylum Support Teams deployed in Cyprus.

 

You may find the two lists in the document attached to this email. For
each module, there is also an indication of the mode of delivery as well
as the number of participants.

 

We would please ask you to reply to us via email by Wednesday 14 December.
Following receipt of your reply, and depending on the number of documents
covered by the scope of your request (as clarified/narrowed down), the
Agency will revert to you with a fair proposal for a handling deadline.
