Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
Current state of the opened file by the European Commission in 2013 for the incorrect application of the European directives related to the internal energy market in Spain.

Thank you for contacting the European Court of Auditors (ECA).
Our institution is responsible for auditing the EU’s finances. Pursuant to
Article 287 of the Treaty on the Functioning of the European Union, we
examine the legality and regularity of the EU’s revenue and expenditure
and the soundness of its financial management, and thereby act as the
guardians of the EU’s finances.
In relation to your request, we would like to draw your attention to the
[1]ECA’s Special Report No 16/2015 ‘Improving the security of energy
supply by developing the internal energy market: more efforts needed’, and
in particular Table 2 (p. 21, version in English) on the European
Commission’s transposition and conformity checks of the Third Energy
Package (as at 30 June 2015), which was produced by the ECA based on
information provided by the European Commission. The ECA does not have a
registry of ongoing infringement procedures, so we cannot provide you with
information or documents on the “current state of the opened file by the
European Commission in 2013 for the incorrect application of the European
directives related to the internal energy market in Spain”.
