I am writing in reply to your emails of 14 October 2014 and 12 November
2014 to the European Data Protection Supervisor (EDPS), regarding access
to documents concerning the legislation which governs the collection,
usage, and sharing of personal data by government authorities.

 

In response to your question, there are three main legislative documents
which currently govern the collection, usage and sharing of personal data
by government authorities. These are Directive 95/46/EC, Directive
2009/136/EC and Council Framework Decision 2008/977/JHA. For more

However, the EU data protection legal framework is currently under review.
The new data protection reform, which has been adopted by the European
Parliament and is currently under discussion in the Council, is expected
to be finalised in early 2015. The European Commission has put forward two
proposals which outline the basis of the expected reform. The first of
these is a General Data Protection Regulation for the protection of
individuals with regard to the processing of personal data and on the free
movement of such data. This document can be accessed using the following

The second is a proposal for a Directive of the European Parliament and of
the Council on the protection of individuals with regard to the processing
of personal data by competent authorities for the purposes of prevention,
investigation, detection or prosecution of criminal offences or the
execution of criminal penalties, and the free movement of such data. This
