Dear International Cooperation and Development,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents in relation to the implementation of the Agreement Establishing the European Union Emergency Trust Fund for Stability and Addressing Root Causes of Irregular Migration and Displaced Persons in Africa, and its Internal Rules (hereinafter the Constitutive Agreement), which should exist on the basis of the following articles:

Article 7.2(e) of the Constitutive Agreement requires “the drawing up of an annual report on the activities financed by the Trust Fund, their implementation and performance, including the results of controls, and on the efficiency and effectiveness of the internal control system” by the Trust Fund Manager to be submitted to the Operational Committee for approval

Article 7.2(g) of the Constitutive Agreement requires “preparing six-monthly and annual financial reports in accordance with Article 8.3.4(a)”

Article 6.3(c) of the Constitutive Agreement requires the Operational Committee “approve the annual report(s) on the activities financed and the annual accounts for transmission to the Trust Fund Board”

Article 6.3(b) of the Constitutive Agreement requires the Operational Committee to “supervise the implementation of the actions financed by the Trust Fund” and to “assess the effectiveness of the internal control systems”

Based on the above, I am requesting:

Any information, data, or reports provided by RRF IOM (project T05-EUTF-HoA-REG-25) and Shire Alliance (project T05-EUTF-HoA-ET-51) to the European Commission (Trust Fund Manager) to comply with monitoring/oversight requirements, which may have been used by Trust Fund Managers to formulate annual reports;

A copy of the annual reports on activities submitted by the Trust Fund Manager of the Horn of Africa window to the Operational Committee for each year since 2016, per Article 7.2(e);

A copy of the annual and six-monthly financial reports prepared by the Trust Fund Manager/Accounting Officer of the Horn of Africa window for each year since 2016, per Article 7.2(g);

A copy of the annual reports since 2016, as transmitted by the Operational Committee to the Trust Fund Board, per Article 6.3(c), if at all modified from what was originally received from the Trust Fund Manager;

Minutes of any meeting of the Operational Committee in which the implementation, results, or effectiveness of internal control systems regarding project T05-EUTF-HoA-REG-25 was discussed, per Article 6.3(b);

Minutes of any meeting of the Operational Committee in which the implementation, results, or effectiveness of internal control systems regarding project T05-EUTF-HoA-ET-51 was discussed, per Article 6.3(b);

A copy of the monthly and six-monthly reports provided by the Commission to the European Parliament on the implementation of EUTFs since 2016, per comments made in response to the 2018 study requested by the CONT committee of the European Parliament and conducted by the Policy Department for Budgetary Affairs

I am happy to provide any clarification that you may need. Thank you in advance for your assistance.

Yours faithfully,
Eric Nodge

Dear International Cooperation and Development,

Thank you for your response and for the attention that you are giving to my request. I understand the reason for the delay. I am curious whether you expect the full 15 additional working days will be necessary; if not, I would greatly appreciate if you could share a (non-binding) estimate of when the documents will be ready. This information would be very helpful to me as I plan to meet forthcoming research deadlines.

Yours faithfully,

Eric Nodge

Dear Mr Nodge,

The extension of the deadline for a reply is done in accordance with
article 7(3) of Regulation 1049/2001, as indicated in the extension
letter.

We understand that for needs of your research deadlines an estimation of
when the documents will be ready would be useful; however, we are not able
to provide you with one as this will vary according to different factors
and administrative constraints, also taking into account the current
COVID-19 crisis.

We thank you for your understanding and apologise for the inconvenience.

Best regards,

Dear International Cooperation and Development,

On 20 May 2020, you invoked Article 3 of Regulation 1049/2001 to extend the deadline by which documents were to be shared by an additional 15 working days, to a new deadline of 19 June 2020. This date has now passed, and I have not received the documents requested nor any acknowledgment of the additional delay that has occurred.

I would respectfully ask that you furnish the requested documents as soon as possible and communicate about when you expect this process to be complete.

Yours faithfully,

Eric Nodge

Dear International Cooperation and Development,

I appreciate your prompt response to my previous message. Given that the response to this request is overdue, I would like to request more detailed information about the nature of the delay. Could you please explain to me the particular cause of the delay that you have referenced and offer a timeline of when you expect my request will be processed?

Yours faithfully,

Eric Nodge

Dear International Cooperation and Development,

Please pass this on to the person who reviews confirmatory applications.

I am filing the following confirmatory application with regards to my access to documents request 'EUTF for Africa Monitoring & Oversight Reports'.

The response to my request is long overdue, beyond both the 15 working days legally mandated by Article 7(1) of Regulation (EC) No 1049/2001 and the additional 15 working day extension that was afforded through Article 7(3) of the same Regulation. Furthermore, I have been furnished no explanation as to the cause of the delay beyond these deadlines and have not been provided a timeline of when the requested documents may be expected, despite my request for these details on 23 June 2020.

In light of this administrative silence, I would kindly ask that my request be reviewed. Thank you.

A full history of my request and all correspondence is available on the Internet at this address: https://www.asktheeu.org/en/request/eutf...

Yours faithfully,

Eric Nodge
