Food Safety Penal Measures

Estamos a la espera de que Ramune Staniene lea una respuesta reciente y de que actualice el estado.

Dear European Food Safety Authority,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1. When did the EFSA first become aware of the fipronil egg contamination which took place in the Netherlands?

2. What preventative measure laws are in place in the EFSA legal framework to ward off similar criminal fraudulent acts committed within the food supply chain in case a similar scandal takes place and the national legislation is absent within the consumer safety failure origin country, or if the country is not strong enough to prevent similar scandals from happening again?

3. While providing the information on the penal preventative measures potent to apply by the EFSA, please specify the levels of monetary fine level, if in place, to accompany the penal laws.

4.In case of the consumer safety failing product recalls, is there a statutory body and procedures to assure the recall process and disposal of the safety failing products to the point where those products can not be recovered and resold back in the market by industry stakeholders?

5. Please provide the data you hold on the top 50 highest monetary penalties Europe wide that were imposed by EFSA, if any , on industry stakeholders in 2016 when the industry stakeholders failed to meet organic food regulations, e.g. organic foodstuff contained synthetic pesticide residues.

I would like the above information to be provided to me as electronic copies via e-mail.
If this request is too wide or unclear, I would be grateful if you could contact me as I understand that under the Act, you are required to advise and assist requesters. If any of this information is already in the public domain, please can you direct me to it, with page references and URLs if necessary.

I understand that you are required to respond to my request within the 20 working days after you receive this letter. I would be grateful if you could confirm in writing that you have received this request.

I look forward to hearing from you.

Yours faithfully,

Ramune Staniene, Autoridad Europea de Seguridad Alimentaria
