Framework for the screening of foreign direct investments into the Union
Dear Madam, Sir
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information related to articles from Regulation (EU) 2019/452 of the European Parliament and of the Council of 19 March 2019 establishing a framework for the screening of foreign direct investments into the Union:
- (Article 5) All annual reports already submitted to the Commission on foreign direct investments and if applicable the application of their screening mechanisms
- (Article 6.1) All Member States' notifications of any foreign direct investment in their territory that has undergone screening
- (Article 6.2) All comments from one Member State to another about screenings
- (Article 6.3) All Commission opinions about screenings
- (Article 6.4) All Member State requests to the Commission or other Member States to provide comments/opinions
- (Article 6.6) All requests for information and replies
- (Article 6.8) All notifications of Member States of its intention to issue a screening decision before the timeframes referred to in paragraph 7; and justifications for immediate action.
- (Article 7.1) All comments from Member States about a foreign direct investment planned or completed in another Member State which is not undergoing screening in that Member State
- (Article 7.2) All Commission opinions on foreign direct investments planned or completed in a Member State which is not undergoing screening in that Member State
- (Article 7.3) All Member States requests to issue an opinion on a foreign direct investment in its territory, and requests to other Member States to provide comments
- (Article 7.5) All requests for information and replies on a foreign direct investments not undergoing screening considered likely to affect security or public order
- (Article 8.1) All Commission opinions on a foreign direct investment considered likely to affect projects or programmes of Union interest on grounds of security or public order
- A list of the documents that fit the above descriptions with their metadata (i.e. author, date, subject)

I am filing the following confirmatory application with regards to my access to documents request about the 'Framework for the screening of foreign direct investments into the Union', which was registered 14 January 2021 under reference number GESTDEM 2021/0207.
The Commission has denied all and any access to documents falling within the scope of my request. It has also refused to provide so-called metadata in the form of a list of documents that exist.
The FDI screening regulation was adopted with the goal to preserving the EU's strategic interest. However, it does not prescribe member states when to screen foreign investments. Rather, it gives them a common framework *if* they screen. It offers them a potential means to cooperate and communicate to each other about screening, but does not offer guarantees that such cooperation will take place to the fullest extent.
It is in the public interest to know if this Regulation is being put to good use. This is the main reason behind my request. It would not be the first time that EU legislation offers member states the potential to work together in the common interest of EU citizens, but that they neglect to use that potential to the fullest extent. EU citizens of the different member states therefore have an interest in knowing whether, and if so how often, their member state have used the potential of the regulation.
I therefore would like to request that the secretariat-general looks at the case again, and see if it can find a way to provide information that does not harm public security interests.
I realise that my request for a confirmatory application arrives after the 15 working days deadline. The reason for this is that I have not yet received the registered letter from DG Trade by mail. I use the AsktheEU website for my correspondence, but the advanced e-mailed copy of DG Trade's letter was somehow misdirected and filed under a different access to documents request, leading to my reading that letter only much later.
I would like to request leniency with regard to the deadline. In particular because DG Trade has also not been able to reply within the required 15 working days, or even the extended deadline of 30 working days.

On 18 May 2021, you informed me that the Commission was not able to respond within the extended time-limit, because "internal consultations" had not yet been finished. Since then, another 28(!) working days have passed. This means that almost twice the period has passed that is supposed to be the maximum amount an EU citizen should be required to wait for their documents.
Unless I have missed something, I have not yet received a reply.
You can understand that this is unacceptable. Please wrap up your internal consultations without delay, but in any case by Tuesday 29 June the latest. Failing that, I will make use of my rights under Regulation 1049/2001 by filing a complaint with the European Ombudsman.
