I am filing the following confirmatory application with regards to my access to documents request 'Frans Timmermans' cabinet meetings with religious lobbyists'.

With regard to the documents attached in the response to my request, all of them have been modified in order to protect the alleged interests of the organizations lobbying on Frans Timmermans' cabinet. In this sense, one could understand that the archives had to be anonymized, in accordance with
Article 4(1 )(b) (protection of privacy and the integrity of the individual) ofRegulation (EC)
No 1049/2001, although protection of personal data of lobbyists making use of a transparency register to get in touch with public institutions can always be subjective.

However, as regards document 12, access has been "partially refused on the basis of Article 4(2), first
indent of Regulation (EC) No 1049/2001 (protection of commercial interests of a legal
person)". Accordingly, this document has not only been anonymized but also hidden to a extremely large extent. The basis of this decision is that "the relevant undisclosed parts of document 12, contain the names, as well as commercially sensitive information, such as views and opinions expressed by members
ofthe Commission ofthe Bishops' Conferences of the European Union (COMECE) in a very specific context". If this reasoning is analyzed carefully, one realizes that comercial interests are not an obstacle to access the information anymore, since "views and opinions" cannot be indisputably taken as such.

Even if the alleged comercial interests would be appropriate, it is important to distinguish between reputational damage and commercial damage. Whether the lobby activities of an organization could have a negative impact on its reputation or not, it must never be an impediment to give access to a certain information, since the lobbying process is transparent and public by itself in its definition. On the other hand, if a religious lobby —registered in the EU transparency register as a "organisation representing churches and religious communities" and not, for instance, as a "in-house lobbyist and trade/business/professional association", discusses commercial interests within the European Commission, it is even more evident that access to communications must be provided to the European public.

Ultimately, Article 4(2), first indent of Regulation 1049/2001 affirms that ‘the institutions shall refuse access to a document where disclosure would undermine the protection of commercial interests of a natural or legal person, [...] unless there is an overriding public interest in disclosure.’ In this case, the public interest in obtaining the original document is superior to any type of supposed commercial interests. On the one hand, citizens have the right to know what is happening or being negotiated in the offices of their representatives; on the other hand, religious lobby plays a crucial roll in the field of human rights, especially in the rights of women and the LGTBI collective, two social groups that are suffering serious attacks that undermine its integrity nowadays.

The previous confirmatory application was sent by mistake. This is the prevalent one:

This is a confirmatory application to challenge the refusal to provide full access to documents related to my request of 26 December 2018 om which I sought to obtain the following documents: “A list of all lobby meetings held by … Frans Timmermans or any other member of its Cabinet with any organisation representing churches and/or religious communities since 2014 onwards, including all emails, minutes/, reports or any other briefing papers related to all those meetings.”
The European Commission has identified and provide us with partial access to twelve (12) documents.
Two exceptions have been applied to the material redacted from this documents. With this confirmatory application, I ask that you review what I would argue is the overbroad application of these exceptions, and the failure to fully and adequately consider the public interest in the release of these documents.
1. No list of meetings provided
In my request I asked for a list of all lobby meetings. I note that no such list has been provided but nor have you stated clearly that you do not hold such a list.
I note that you referred me to the Transparency Register for a reports on meetings held with organisations representing churches and religious communities. Whilst this is useful information for which I thank you, it appears that not all such organisations are registered in the lobby register, and certainly not all churches, religious associations, and communities are registered there.
Therefore, in order to have a clearer picture of all meetings held, I would need a full list of such meetings.
Could you please kindly confirm whether or not such a list exits.

2. Protection of Privacy
You have applied article 4.1.b of Regulation 1049/2001, combined with the provisions of Regulation 2018/1725 to deny access to the names of some members of the Commission staff as well as to protect the privacy of other individuals such as members of boards of organisations representing churches and religious communities.
This protection of privacy of those who are acting as interest group representatives is a departure from the general principle that all those who meet with senior Commission officials shall have those meetings made public, in accordance with the Commission decision of 25 November 2014, Article 3, which states that the principle of transparency of such meetings does not apply to “meetings held in the context of the dialogue with churches, religious associations or communities, as well as with philosophical and non-confessional organisations.”
You state in your decision letter, as is stated in the abovementioned Commission decision, that “to respect … the specific character of the dialogue with churches and philosophical and non-confessional organisations, provided for in Article 17(3) TFEU, meetings taking place in those contexts should not be covered by this Decision.”
It is not clear how such an exclusion is justified, given that Article 17(3) TFEU specifically requires that “Recognising their identity and their specific contribution, the Union shall maintain an open, transparent and regular dialogue with these churches and organisations.”
In other words, in addition to the general principles of transparency and openness contained in Article 15 TFEU, there is a further, specific, requirement for openness of dialogue with churches and religious associations or communities, as well as with philosophical and non-confessional organisations (Articles 17(1) and 17(2) TFEU respectively).
I would therefore argue that there is a clear and overriding public interest in accessing information about the representatives of all representatives religious (and other) communities and that this is supported by – even mandated by – a specific treaty requirement.
Furthermore, it is essential that members of the European public are able to know who in particular from these organisations is presenting policy arguments. I note that it is not only public figures who are the heads of these institutions who are sufficiently well known to merit having their names made public when they are acting as interest representatives (lobbyists). I further note that this is precisely the principle that you apply for other interest groups, where the privacy argument does not prevail, and that should be even more so the case here given Article 17(3).
In terms of a specific interest, I inform you that I need this information as part of journalistic research into the way in which religious communities are making their case in Brussels, and I need to be able to identify which individuals are communicating with senior European Commission officials in order to be able to understand precisely how this lobbying is taking place for use in journalistic output designed to inform public debate.

3. Commercially Sensitive Information
In denying access to the majority of Document 12 on the grounds of Article 4(2) first indent, you argue that it contains commercially sensitive information, which it then goes on to state are the “views and opinions expressed by members of the Commission of the Bishops’ Conference of the European Union” and that these “would have a negative effect on their reputation and public image, thus affecting their commercial interest.”
You cite jurisprudence from the Court of Justice of the European Union about protecting business strategies, and then add that “Even if the Commission of the Bishops' Conferences of the European Union is not an undertaking acting in the private interest, I note that the reputational damage mentioned.” Furthermore, even if the analogy were apt, the jurisprudence you cite does not cover information that is merely “views and opinions” rather than concrete business strategies.
It seems that here there is an inappropriate conflation of the concept of damage to the reputation of an organisation and the need to protect – unspecified – commercial interests. Regulation 1049/2001 Article 4(2) first indent is not designed as a general protection of reputations. (Indeed, I would refer you to the extensive jurisprudence of the European Court of Human Rights on the issue of true information and reputations, particularly where a legal person rather than a private person is concerned). Hence the application of this exception seems inappropriate in this context and I ask that you reconsider it.
Even if you were to find that there is potentially some damage to whatever the legitimate commercial interests of Commission of the Bishops’ Conference of the European Union might be, there is clearly an overriding public interest here.
The European Commission has recognised the need for transparency of lobbying in establishing the Transparency Register, which requires that any activity that constitutes lobbying (any policy advocacy by interest groups) must be open. Hence the requirement for registration by every "in-house lobbyist and trade/business/professional association", and the requirement that there be transparency when they discuss commercial interests within the European Commission. This general principle should apply here.
Furthermore, the first is that the Union’s dialogue with the confessions must be open and transparent. I refer to Article 17(3) TFEU, cited above, which creates a very specific requirement of openness of such dialogue.
Citizens have a right to know what is happening or being negotiated in the offices of their representatives. This is particularly the case with the religious lobby, which plays a crucial role in the field of human rights, especially in the rights of women and the LGTBI collective. It is imperative that members of the public are able to know about the way in which these issues are being discussed in Brussels and what attempts there might be to influence policy.
In this case I am a journalist working to bring to light information about the policy advocacy activities of religions and their organisations, in order that there be a strengthened and more informed public debate.

which you submit a confirmatory application in accordance with Article
7(2) of Regulation (EC) No 1049/2001 regarding public access to European
Parliament, Council and Commission documents.

 

I would like to inform you that your confirmatory application is currently
being handled. Unfortunately, due to ongoing consultations, we are not in
a position to reply to your confirmatory request within the prescribed
time limit expiring on 10 April 2019. Consequently, we have to extend this
period by another 15 working days in accordance with Article 8(2) of
Regulation (EC) No 1049/2001. The new deadline expires on 7 May 2019.

 

I can assure you that we are doing our utmost to provide you with a final
reply as soon as possible.
