Information on state aid complaints

Dear Competition,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1. Total number of state aid complaints received by Directorate General Competition in each year since 2008.

2. Total number of state aid complaints not raised with the relevant member state by Directorate General Competition in each year since 2008 (this might be for any reason such as the case handler deciding the person submitting the complaint does not meet the interested party test).

3. Total number of state aid complaints made to Directorate General Competition about the UK in each year since 2008

4. Total number of state aid complaints not raised with the UK by Directorate General Competition in each year since 2008 (this might be for any reason such as the case handler deciding the person submitting the complaint does not meet the interested party test).

5. Total number of state aid complaints made about the Scottish Government in each year since 2008.

6. Total number of those state aid complaints made about the Scottish Government that were not raised with the UK broken down by each year since 2008.

7. Total number of state aid complaints made about the Homes and Communities Agency (now Homes England) in each year since 2008.

8. Total number of those state aid complaints made the Homes and Communities Agency (now Homes England) that were not raised with the UK broken down by each year since 2008.

9. Any letter from the European Ombudsman to Directorate General Competition raising concerns about the new discretionary approach applied to the interested party requirement in state aid complaints.

We refer to your e-mail dated 13/03/2018 in which you make a request for
access to documents, registered on 15/03/2018 under the above mentioned
reference number.

With regard to your questions, we would like to inform you that we can
only automatically extract data from our system at the level of the Member
States involved. More refined statistics would require a manual analysis.

Please find below a breakdown by year of the 3183 State aid complaints
registered by DG Competition since 01/01/2008:

Regarding your point 3, please find below the number of State aid
complaints made to DG Competition about the UK in each year since 2008:

 

As for your point 9, the only document that corresponds to the description
given in your request is a decision of the European Ombudsman closing her
inquiry against the Commission and founding no maladministration by the
Commission. We are pleased to enclose the non-confidential version, with
personal data redacted, of this decision.

For the rest of your request, the reply to the questions would require a
case by case manual analysis. There is unfortunately no specific document
corresponding to this part of your request.
