Job move by David Reed
Dear Internal Market and Services (MARKT),
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting all documentation relating to Commission decisions made about the job move by David Reed, from the European Commission (DG Internal Market and Services), to Houston Consulting in 2008.
Specifically, I would like to receive all his EU job titles and the dates that these posts were held, the date of his application for permission to move to Houston Consulting, the date of the official EU response, whether or not the job move was approved, the reasons given, and any conditions that the EU attached to the approval of this external post at Houston Consulting.

An extended time limit is needed as your application due to necessary internal consultations

Dear Ms. Araúzo,
In reply to your query concerning the move of David Reed to Houston
Consulting in 2008, please find enclosed a summary of the career record of
Mr. Reed from the Commission HR database, in which all details concerning
his job titles, areas of responsibility, and dates in which he occupied
these functions appear. As you can see in the document attached, Mr. Reed
spent a total of 3 years as a National Expert in Detachment to the
Commission. His Institution of origin was the Financial Services Authority
(FSA) in the United Kingdom.
The current rules governing the secondment of national experts to the
Commission are specified in the Commission decision C(2008)6866/3 of the
12th of November 2008 on national experts on secondment. According to this
decision, the expert in detachment to the Commission is subject to legally
binding obligations concerning confidentiality and avoidance of conflict
of interest, also after the secondment is terminated. For instance,
according to paragraph (3) of Article 7:
"At the end of the secondment the SNE (Seconded National Expert) shall
continue to have a duty of loyalty to the Communities and be bound by the
obligation to act with integrity and discretion in the exercise of new
duties assigned to him and in accepting certain posts or advantages"
It is worth noting that, as part of the detachment agreement of Mr. Reed
to the Commission and on top of the applicable rules set out by the
Commission on Seconded National Experts, Mr. Reed also signed a statement
of honour which includes an obligation from his side of informing the
Commission, during the three years after the period of the secondment, of
any duties to be carried out for his employer which would could give rise
to any conflict of interest in relation to his duties while seconded in
the Commission.
However, the national expert remains an employee of his/her Institution of
origin, hence the responsibility over the career aspects of the person in
question lies with his/her employer, in this case the FSA. Therefore, Mr.
Reed did not have the obligation to consult formally the Commission about
his career plans, nor does the Commission therefore have any official
record concerning his career plans. We would advise you to contact the FSA
in this respect.
In short, the Commission, and particularly DG MARKT in this case, takes
all necessary precautions to prevent any potential conflict of interest of
national experts in detachment.
