Legal advice on disembarkation platforms and centres

Dear European Parliament,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting access to:

- all documents generated or received by the European Parliament containing legal advice and/or an analysis of the legality of the so-called disembarkation centres, disembarkation platforms, and/or regional disembarkation arrangements, presented in the conclusions of the European Council meeting of 28 June 2018. I am interested in documents drawn up both before and since the meeting was held, to date.

Please do not hesitate to contact me if you need any clarification in regards to any aspect of my request.

Dear Ms Izuzquiza,

This is a reply to your application for access to Parliament documents concerning the legality of the so-called disembarkation centres, disembarkation platforms, and/or regional disembarkation arrangements, presented in the conclusions of the European Council meeting that was held on 28 June 2018.

To this day of 5 July 2018, Parliament and the services of its administration competent in these matters have not produced or received documents with legal advice and/or an analysis of the legality of the so-called disembarkation centres, disembarkation platforms, and/or regional disembarkation arrangements, presented in the conclusions of the European Council meeting that was held on 28 June 2018 (http://www.consilium.europa.eu/en/meetin...).

Please note in this respect that according to Rule 116(2) of the Rules of Procedures, for the purpose of access to documents, the term 'Parliament documents' means any content within the meaning of Article 3(a) of Regulation (EC) No 1049/2001 which has been drawn up or received by officers of Parliament within the meaning of Title I, Chapter 2, of these Rules, by Parliament's governing bodies, committees or antiparliamentary delegations, or by Parliament's Secretariat. And that in accordance with Article 4 of the Statute for Members of the European Parliament, documents drawn up or received by individual Members or political groups are Parliament documents for the purposes of access to documents only if they are tabled in accordance with the Rules of Procedure.
