please find enclosed a reply letter concerning your access to documents
request GestDem 2018/1258 and the requested document.

 

As foreseen by Article 297 of the Treaty on the Functioning of the
European Union (TFEU), decisions which specify to whom they are addressed,
shall be notified to those to whom they are addressed and shall take
effect upon such notification. Replies triggering the possibility for
administrative or judicial redress are therefore transmitted via
registered mail with acknowledgement of receipt.

 

In order to obtain legal certainty as regards the date of receipt of the
reply by the applicant under Regulation 1049/2001,  the following
categories of replies are normally sent via registered mail:

 

- Negative reply

- Partially negative reply

- Devoid of purpose reply (=no documents found)

- Reply containing documents from which personal data has been redacted

 

The letter would normally be sent to you via registered mail. However, in
connection with a previous access to documents request you requested to
receive only a digital copy of such replies.

 

Thus we consider that the period of fifteen working days for making a
confirmatory request starts to run from tomorrow (the day after the reply
e-mail is sent). Please don't hesitate to let us know if this information
is no longer valid and you would like to receive the letter via registered

Please pass this on to the person who reviews confirmatory applications.

I am filing the following confirmatory application with regards to my access to documents which was registered on 06/03/2019 under reference number GestDem 2019/1258.

My request was: The commission's legal analysis of the General Court of the European Union's Judgment in Cases T-339/16 Ville de Paris v Commission, T-352/16 Ville de Bruxelles v Commission, T-391/16 Ville de Madrid v Commission

Instead, the Commission said it could find only one document related to my request, namely an e-mail of 4 March 2019 from Commissioner Bieńkowska to MEP Van Brempt.

However, Commissioner Bieńkowska had made reference to the existence of a legal analysis already during an exchange of views with the European Parliament's environment committee, as a follow-up to EMIS, on 20 February 2019. By definition, the legal analysis to which I referred cannot be an email sent later than that exchange of views.

In any case, an email is not a legal analysis. The comments from Commissioner Bieńkowska on 20 February 2019 suggested that there existed some kind of document in which the Commission's legal services displayed its interpretation of the Court's judgment. It is that document which I requested - which should have been clear to the DG from my simple request.

and nature of the requests for access to documents the Legal Service is
dealing with, we will not be in a position to complete the processing of
your request within the time limit of 15 working days, which expires
today, the 30^th of April 2019.

 

For this reason, we will need to extend the time limit by 15 working days,
in accordance with Article 7(3) of Regulation (EC) No 1049/2001. The new
time limit expires on 23/05/2019.

 

However, we will do our outmost to come back to you with a reply in the
