Dear DG Trade colleagues,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Digital trade and/or electronic commerce in combination with
- source code of software
- trade secret
- algorithm
- artificial intelligence

I am interested in documents that contain legal assessment of the internal compatibility of the source code of software clause with European Union law.

Thank you for your email. As indicated in my request I would like to receive documents held by DG Trade about "digital trade" and/ or "electronic commerce" in combination with any of the following keywords:
- "source code of software"
- "trade secret"
- "algorithm"
- "artificial intelligence"

The documents could arise in any of the following contexts :
- the European Commission's trade strategy and policy, including background documents;
- documents send to the European Parliament (e.g. IMCO Committee), the Foreign Affairs Council (Trade), and intra-Commission communication, incl. email;
- concluded bilateral free trade agreements of the EU and currently negotiated bilateral free trade agreements of the EU;
- the Joint Statement Initiative (JSI) on an agreement on trade-related aspects of electronic commerce that is currently negotiated among WTO members;
- in the context of the EU-US Trade and Technology Council (TTC), the OECD, the G7, the G12 and other international fora.

I am interested in all documents I described above and in particular legal assessments about the source code of software clause and the internal compatibility of the source code of software clause with European Union law.

Dear Madam,

We refer to your e-mail of  20 June 2022 in which you make a request for
access to documents, registered on 21 June 2022 under the above mentioned
reference number.

Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires on 12 July 2022.

An extended time limit is needed because of the high number of requests
being handled.  

Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 3 August 2022.

We apologise for this delay and for any inconvenience this may cause.
