Legal costs to DG COMP of defending decision in Case AT. 39740

Dear colleagues,

Under the right of access to documents in the EU treaties, provided in Regulation 1049/2001, I request documents about the financial cost of legal and related expenses, including permanent staff cost where relevant, to the Commission of defending DG Comp's decision in Case AT.39740 concerning Google Shopping, which included a fine of €2.4 billion.

To assist your gathering of these documents, note that DG Comp announced its decision on 27 June 2017, and I request documents from that date to the present day.

This request for documents includes, but is not limited to, minutes; notes, whether hand written or typed; audio recordings; verbatim reports; e-mails; correspondence, telephone calls, video calls, publications; reports; presentations; telephone calls; and policy papers.

There is no valid procedural requirement that permits a refusal to register a request to access documents pending the provision of a postal address. Nor is any such requirement is cited in your correspondence.

The Commission has rightly directed its staff to work from their homes to reduce the risk to their health from Covid-19. Your requests are currently being handled. However, in view of the number
and nature of the requests for access to documents the Legal Service is
dealing with and given the extraordinary situation due to the coronavirus,
our services are presently working with limited resources.

 

In this context, we will not be in a position to complete the processing
of your requests within the time limit of 15 working days, which expires
today, the 29 April 2020.

 

For this reason, we will need to extend the time limit by 15 working days,
in accordance with Article 7(3) of Regulation (EC) No 1049/2001. The new
time limit expires on 25 May 2020.
