Please pass this on to the person who reviews confirmatory applications.

I am filing the following confirmatory application with regards to my access to documents request 'Letter to Volkswagen', registered on 11/09/2017 under reference number GESTDEM 2017/5470.

The reason given for not releasing the document, is that they are part of "ongoing investigations". But the subject as well as parts of the content of the letter have been made public in a Commission press release dated 7 September 2017 (http://europa.eu/rapid/press-release_IP-..., and an ACM press release the same day (https://www.acm.nl/nl/publicaties/public....

Unless those press releases are also part of "ongoing investigations" - and therefore in hindsight should not have been published! - the argument against at least partial disclosure does not hold.

Beyond that, the signatory of the letter determining whether the document should be kept confidential, is also the co-signatory of the document involved: Ms Tiina Astola. To avoid any conflict of interests, it would be better if another person than the one whose letter is subject to my request, could review the application.

I refer to your email of 24 October 2017, by which you submit a
confirmatory application in accordance with Article 7(2) of Regulation
(EC) No 1049/2001 regarding public access to European Parliament, Council
and Commission documents[1] (‘Regulation 1049/2001’).

Your confirmatory application is currently being handled. Unfortunately,
we have not yet been able to gather all the elements we need to carry out
a full analysis of your request in order to take a final decision.
Therefore, we are not in a position to reply to your confirmatory request
within the prescribed time limit expiring on 17 November 2017.

Consequently, we have to extend this period by another 15 working days in
accordance with Article 8(2) of Regulation 1049/2001. The new deadline
expires on 8 December 2017.

I apologise for any inconvenience this delay may cause and would like to
reassure you that we will endeavor to send you our reply as soon as
